Oh, but the downwind vessel has the almighty Right Of Way.

Riptide--despite the antiestablishment comments by isobars, the rules of the road serve a very important purpose in keeping all of those on the water safe. The object of right-of-way rules is to make the course corrections of any two sailors on an approaching course predictable. That includes starboard right-of-way and leeward boat right of way. In fact, the windward boat as more maneuverability than the leeward boat. They can pinch up modestly without losing steerage, and such clear course changes are evident to the approaching sailor. There are many excellent discussions, including this on http://www.101surfsports.com/index.php/stand-up-paddleboarding-sup-marin-county-san-rafael/basic-water-safety-bay

I've sailed and raced on San Francisco Bay for 35 years, and had only 2 collisions, both with beginners on sailboats that changed course suddenly. A number of close calls, most due to my error in not scanning my course for potential collisions. Safety is paramount.

right of way rules don't take getting air into account. i've had more instances of windsurfers doing it directly in front of me than kiters. kiters can do it almost anywhere. some windsurfers see a good ramp and have to take it no matter who's around.

also two riders trying to pinch upwind of each other can be a recipe for disaster. it's a game of "quien es mas macho?"

be aware and keep a safe distance

Not antiestablishment. Anti-I-have-the-ROW-and-can-outpinch-you-so-you-must-jump-in-the-water-and-let-me-through.

Victor--there have been several very serious accidents with two sailors in the air on opposite tacks. The r-o-w rules apply, as well as a responsibility to avoid a collision even if you have the right of way. Nobody should jump where they might collide in mid-air--and if they do, the port tack sailor is liable.
