It’s been several years since Kansas Republicans first imposed new voting restrictions on state residents, including requirements that Kansans show proof of citizenship when registering. The ACLU is challenging the measure in federal court, while Secretary of State Kris Kobach (R) defends them.

That is, of course, the same Kobach who’s championed voter-suppression techniques at the national level, and helped lead Donald Trump’s ridiculous voting commission, which recently ended in failure.

It’s safe to say this latest endeavor isn’t going especially well, either. A federal judge yesterday held Kobach in contempt of court, and the Washington Post did a nice job explaining why.

U.S. District Judge Julie Robinson issued a preliminary injunction in 2016 blocking the [Kansas law related to voter registrations] and asked that the registrations of some 18,000 people whose materials had been held be notified with a postcard confirming their registration and polling place, as other voters are in Kansas.

But the ACLU recently charged that many voters had failed to receive the postcard…. Robinson sided with the ACLU’s January motion to hold Kobach, Kansas’s secretary of state, in contempt for the failures, as the court had ordered him previously to comply.

In her ruling, in which she said twice that Kobach acted “disingenuously,” Robinson wrote that she found “clear and convincing evidence” that he had disobeyed the preliminary injunction.

NBC News’ report on this added that this wasn’t the first time: “Kobach was held in contempt of court last year, too, for misleading the court about documents he was photographed bringing into a meeting with the president.”

Slate’s Mark Joseph Stern recently pulled together a list of “all the ways Kris Kobach has already lied to the court that’s overseeing his Kansas voter fraud trial,” and it wasn’t a short list.

I’m not an attorney, but I get the sense federal judges aren’t pleased when lawyers lie to them – especially in a voting-rights case in which one of the lawyers is also the state’s chief elections official.


As for the case on the merits, it doesn’t look like Kobach is doing especially good job on this front, either. The New York Times recently published this gem:

Of course, restrictive voting laws like these have never been about protecting electoral integrity. They’re about keeping certain people away from the ballot box, often based on who they are — or are assumed to be. [In March], one of Mr. Kobach’s witnesses, a political scientist, Jesse Richman, testified that up to 18,000 noncitizens have registered or tried to register in Kansas. When the A.C.L.U.’s lawyer asked him about his methods for analyzing the state’s list of suspended voters, Mr. Richman said that, among other things, he flagged foreign-sounding names.

What about a name like “Carlos Murguia,” the lawyer asked. Would he flag that one? Yes, Mr. Richman said. He was then informed that Carlos Murguia is a federal district judge who sits in the courthouse where the trial is being held.

Kobach, it’s worth noting, is also a Republican candidate for governor this year. Though there are several candidates in the GOP field, Kobach is generally seen as a top contender for his party’s nomination.

And with an independent candidate in the mix, who’ll likely split the mainstream vote, it means there’s a decent chance that a national pioneer in voter suppression – who’s now been held in contempt of court twice – will be Kansas’ next governor.

A Michigan Republican activist convicted of election fraud had VIP access to President Donald Trump’s April rally in the state.

In 2012, Brandon Hall forged signatures to get a judicial candidate on the ballot in Ottawa County, Michigan. He was convicted of 10 counts of election fraud and sentenced in 2016 to 30 days in jail and 18 months probation. He is still serving the probation portion of his sentence.

Hall was a volunteer on Trump’s campaign in Michigan and had VIP access to his rally in the state on April 28, according to photos he posted on his Facebook page.

The photos showcase Hall’s front-row seat to Trump’s rally in Washington, Michigan. One of the pictures shows him standing at the same lectern where Trump spoke.

SHOCKING NEWS! However, since a significant percentage of the student body at most colleges and universities are foreign students and illegals, why would anyone allow a college I.D. to be used for voting?

On the other hand, the real proof is needed when registering to vote, and what is required at the polling place is pretty loosey goosey. My experience is that you show your registration card, which could be anybody's since there is no photo.

A year later, in February 2018, the president spoke at a Republican National Committee dinner, and again claimed that the only reason he narrowly lost New Hampshire in 2016 was voter fraud.

Given his intense and ongoing interest in the subject, someone probably ought to alert him to this report from WMUR.

An exhaustive review by state election officials, including a first-time comparison of voter information shared with 27 other states, has turned up virtually no evidence of possible voter fraud in New Hampshire, those officials said Tuesday.

Secretary of State William Gardner, other officials from his office and a top election law attorney from the attorney general’s office made a more than two-hour presentation to the state Ballot Law Commission, which is charged with resolving disputes related to election laws. The review consumed 817 work hours by members of the attorney general’s office with help from the Department of Safety.

The review process was actually pretty interesting. New Hampshire officials started with the highly dubious Crosscheck system, which pointed to more than 94,000 possible examples of people casting more than one ballot. Secretary of State Bill Gardner was able to quickly narrow that list down to 4,579. After accounting for middle names and initials, the list shrunk again to 3,624.

Using a variety of related methods, the state continued to gradually narrow the list from 955 to 142 to 91 to five. Does that mean New Hampshire found five real-world examples of actual voter fraud?


Not exactly.
As Slate’s Mark Joseph Stern explained, “One college student voted in the wrong location on the faulty instruction of an election official. An elderly woman appears to have filled out her recently deceased husband’s absentee ballot. Two people cast a ballot in Dixville Notch’s famous midnight primary without establishing domicile there. Just one person actually voted twice; he was fined $2,500 and threatened with criminal prosecution if he ever did it again.”

That’s it. That’s all the evidence showed.

The point isn’t that the results are surprising. They were actually quite predictable. Rather, the point is that Trump and his team peddled a ridiculous conspiracy theory and not only expected the public to believe it, but also hoped their bogus claims could help create a demand for new voting restrictions across the country.

Indeed, it wasn’t just Trump. Stephen Miller appeared on ABC News last year and insisted, “I have actually, having worked before on a campaign in New Hampshire, I can tell you that this issue of busing voters into New Hampshire is widely known by anyone who’s worked in New Hampshire politics. It’s very real. It’s very serious.”

It’s also very imaginary. The White House’s apology will be issued any day now, right?

my take is, I am innocent till proven guilty in america.
It is the responsibility of the state to determine in a court of law with a jury of my peers if I have perjured myself.

This is ash backward they the right wing haters of the constitution and human law are deeming you guilty without due process. When a person says they are an american they have to prove it in front of a jury before they can remove you from voting.

why aren't these lawyers going that direction...
