No, I am not confused. I pretty much stated the same concept. It's easy to go back and read; there isn't too much of my statement to review. But of course this medium is far inferior to a bonafide conversation between live 4-D humans.

Somehow got to agree. I have always assumed that if somebody can jibe into me (on the same tack) then I am somewhat to blame. It irks me a little if it is in the middle of the river - assume it will happen (and avoid it) if it is on one of the far sides. The fact is that someone ahead and near upwind of you is going to jibe sometime... |

Yeah I think a better plan is to expect people to do SOMETHING when they get to the edges of the river. But they can always do something in the middle also (don't follow me close). Maybe we should just keep it simple and look out for each other.... |

This statement is why I thought you were confused. Flipping the bird is not assault unless combined with another act creating a reasonable fear in the person given the bird. Disorderly conduct does not require the additional act creating reasonable fear.

Folks playing on the swell very often slash 90 to 180 degrees ANYWHERE, very often, and far too spontaneously to predict. It's very smart not to follow them in their lee. |

Anyone who gets angry about being flipped off or cursed out is an idiot, plain and simple. Besides being protected speech -- even to a cop last I heard -- it's a big So What? No one with a healthy ego REALLY want to get arrested and jailed just because some idiot insults them. |

That, under many circumstances (any dangerous weapon including a BIG fist or martial arts expertise), is usually considered aggravated assault, aka ADW. One goes that far to protect his life, not his lunch or his ego. |
