(Bloomberg) -- Fox News must face a lawsuit by the parents of a Democratic Party staffer whose unsolved 2016 murder touched off a flurry of right-wing conspiracy theories, a federal appeals court ruled.

The parents of Seth Rich sued Fox News over “sham” stories that ran in May 2017 claiming their son had leaked Democratic National Committee emails in the run-up to the 2016 election. The stories, which Fox later retracted, cited unidentified law-enforcement sources. A lower-court judge in Manhattan dismissed the case last year.

On Friday, the Manhattan-based appeals court revived the lawsuit, saying Joel and Mary Rich had adequately alleged that they suffered from “what amounted to a campaign of emotional torture.” The purpose of the stories, according to the Riches, was to take the heat off the Trump administration as investigators probed whether Russian-backed hackers had leaked the emails to advance Donald Trump’s presidential candidacy.


“We would not wish what we have experienced upon any other parent -- anywhere,” the Riches said in a statement. “We appreciate the appellate court’s ruling and look forward to continuing to pursue justice.”

As of last year, Washington, D.C., police hadn’t identified any suspects in what they say was a botched robbery, but the killing led to politically charged speculation in conservative news media that it was Rich who provided the hacked emails to WikiLeaks and that he was killed to silence him.

“This decision now clears the way for a thorough investigation into the facts,” Lenny Gail, an attorney for the Rich family, said in a statement. “We will now obtain documents from Fox News and other parties and take testimony under oath from those involved.”

The appeals court found that the Riches’ claims about what the stories’ authors knew of the murder and the couple’s “susceptibility to emotional distress” were sufficient for the suit to go forward. The fact that they proceeded “in the face of this knowledge makes the authors’ conduct plausibly extreme and outrageous,” the court said.

“The court’s ruling today permits Mr. and Mrs. Rich to proceed with discovery to determine whether there is a factual basis for their claims against Fox News,” the network said in a statement.

Gretchen Carlson wants to speak freely about Fox News tenure

“Companies are saying that they want to be open and transparent and that they have worked tirelessly to make their work environments safer,” she told The Associated Press. “And if that’s the truth, then they should let us out.”


Carlson got a reported $20 million settlement in 2016 after she sued the network, claiming late Fox News chief Roger Ailes demoted then fired her when she rejected his sexual advances.

Fox News publishes digitally altered and misleading images of Seattle demonstrations

The Seattle Times, however, reported that the statement was inaccurate. The newspaper pointed out that "the gunman photo was taken June 10, while storefront images it was melded with were datelined May 30 by Getty Images."
Photojournalism ethics experts told The Seattle Times that Fox News behaved inappropriately when it published the digitally altered images.
"I think it's disgraceful propaganda and terribly misrepresentative of documentary journalism in times like this, when truth-telling and accountability is so important," Kenny Irby, a photojournalism ethics expert, told the newspaper. "There is no attribution. There is no acknowledgment of the montage, and it's terribly misleading."
Akili Ramsess, executive director of the National Press Photographers Association, told The Seattle Times that it was "completely egregious to manipulate this the way they have done."

Fox News Fires ‘America’s Newsroom’ Co-Host Ed Henry After Sexual Misconduct Investigation

“America’s Newsroom” co-anchor Ed Henry is out at Fox News following an accusation of “willful sexual misconduct in the workplace years ago,” according to an internal memo from Fox News Media CEO Suzanne Scott and Fox News Media President & Executive Editor Jay Wallace.

The decision was announced Wednesday, six days after the company received the complaint from the lawyer for the former employee accusing Henry. He was suspended, per the memo, on June 25, the day the accusation was made, then fired based on the findings of an outside law firm that was retained that same day.

Douglas Wigdor, the attorney for the unnamed accuser, declined to comment further Wednesday.

Henry co-hosted the Fox News program opposite Sandra Smith since January 2020. He replaced Bill Hemmer. The network will fill Henry’s spot with rotating anchors until a permanent replacement is found. He joined Fox News in 2011 as chief White House correspondent after three years at CNN, then served as Fox News’ chief national correspondent.
