The suit, filed in U.S. District Court in Manhattan, comes after the network's announcement that it had parted ways with Henry after having been made aware of a past accusation of sexual harassment.


In addition to Henry, the federal suit accuses on-air personalities Sean Hannity, Tucker Carlson and Howard Kurtz of harassing a woman in various instances.

The lawsuit includes allegations by two women, Jennifer Eckhart, a producer for Fox Business, and Cathy Areu, who frequently appeared on the network. The contents are so graphic in parts that the complaint comes with a "trigger warning" about its sexual nature.

Henry, who was co-anchor of "Fox & Friends Weekend" before he was promoted to the network's weekday current affairs program "America's Newsroom," is said to have "sexually assaulted her [Eckhart] on office property and raped her at a hotel where Fox News frequently lodged its visiting employees," the complaint says. The suit also details lurid communications it alleges Henry sent to both women.

Henry is also accused of sending Areu, a regular guest on Fox News, "wildly inappropriate sexual images and messages — which are in her possession — throughout the first half of this year," according to the complaint.

Eckhart is suing Henry and the network for violation of sex trafficking laws and human rights laws and gender-motivated violence. Areu is suing for violations of human rights laws and gender-motivated violence.

Henry's attorney, Catherine Foti, said in a statement: "The Me Too movement has helped to bring to light a number of injustices in our society, and everyone that has suffered deserves to be heard. This is not one of those cases." The statement continued, "The evidence in this case will demonstrate that Ms. Eckhart initiated and completely encouraged a consensual relationship." Foti added that Eckhart had sent other "aggressively suggestive communications."

Foti had no further comment when asked to respond to Areu's allegations.

The suit alleges that Hannity offered $100 to a group of men at Fox News to take Areu on a date. Carlson and Kurtz are alleged to have asked Areu to meet them at a hotel.

In a statement, Fox News, which is also named in the suit, said: "Based on the findings of a comprehensive independent investigation conducted by an outside law firm, including interviews with numerous eyewitnesses, we have determined that all of Cathy Areu's claims against Fox News, including its management as well as its hosts Tucker Carlson, Sean Hannity and Howard Kurtz and its contributor Gianno Caldwell, are false, patently frivolous and utterly devoid of any merit."

Representatives for Carlson, Hannity and Kurtz were not reachable for comment at time of publication. Carlson, who hosts "Tucker Carlson Tonight," was host of the nightly program "Tucker" on MSNBC from 2005 to 2008.

In a statement provided by the law firm Wigdor LLP, which has represented 20 claims against Fox News, Eckhart said, "I stand for all victims who have been mistreated, harassed, assaulted, and even worse, at the hands of those in power, and the institutions that continue to support them."

The network said the two women were free to pursue their claims against Henry "as Fox News already took swift action as soon as it learned of Ms. Eckhart's claims," which were made June 25.

Wigdor lawyer Michael J. Willemin, who represents the women, countered the Fox News statement, saying "the complaint asserts that Fox News did nothing" even though it was aware of the claims against Henry for some years.

The explosive lawsuit represents a fresh round of serious sexual misconduct allegations for Fox News after the network fought to present itself as a much-changed organization.

Fox News parted ways with prime-time anchor Bill O'Reilly and the network's founder, the late Roger Ailes. Both men were also accused of wrongdoing, which both men denied.

The suit also claims that it is "widely documented in the public record that Fox News has not only cultivated and fostered sexual harassment and misconduct, but has consistently accepted and rewarded it."

"Nevertheless, Fox News would have the public believe that it is a different place from the Fox News that was run by former disgraced Chairman and CEO Roger Ailes," the suit says.

"Unfortunately, it is actually worse," the suit continues.

Fox News said in a statement, "We take all claims of harassment, misconduct and retaliation seriously, promptly investigating them and taking immediate action as needed — in this case, the appropriate action based on our investigation is to defend vigorously against these baseless allegations."

Several news organizations, including NBC News and CBS News, have dealt with allegations of serious sexual misconduct within their own ranks in recent years.

IN THE 1980s, Frank Senko found himself behind the wheel of his car for several hours each day, commuting. He didn’t really care for music, but he didn’t want to be bored. So he tuned into talk radio.

And then he started to change.

Frank had always been the neighborhood “fun dad,” goofy and friendly; he was a Democrat and a “hippie before there were hippies,” his daughter said — happy to live and let live. Not anymore. “He became more irritable, cranky, irascible, a little more judgmental with people,” said Jen Senko, his daughter.

Not long after, Frank installed heavy sliding glass doors between the two rooms so he could listen undisturbed.

A man who’d made his children read for an hour before bedtime, who always told them that higher education was the most worthwhile thing they could do, became suspicious of universities as liberal incubators. A man who used to stop people on the street when he heard an accent he didn’t recognize to say hello now didn’t like immigrants or Hispanic people. A man who’d welcomed his children’s gay friends into his home “didn’t want it in his face” anymore.

“He became a person we hated being around and we didn’t know. It was like that movie [Invasion of the Body Snatchers]: ‘What happened to Dad?’” said Senko. “It was a really horrible period of time for us . . . It was a nightmare, both my brothers blocked him, I blocked him.” Senko’s stomach clenched every time she thought of visiting. Her dad was angry all the time. And Senko knew exactly what was to blame: The steady drip-feed of outrage he listened to every day.

Senko turned the story of her dad’s descent into anger into a 2016 documentary called “The Brainwashing of My Dad,” narrated by Matthew Modine. The film was partly funded by 947 Kickstarter donations, many from people who had dads, moms, and loved ones who had plunged down the rage-filled rabbit hole of talk news and emotionally predatory media platforms. Exposure to angry media had turned loved ones into angry people, cloaked in righteousness, their families didn’t recognize. “It was insane — you understand how cults operate,” said Senko.

It’s still happening: Actor Mark Ruffalo recently tweeted that he’d lost an uncle to Fox News.

Anger’s ubiquity, its stickiness, indicates that we get something out of it. Frank Senko’s anger had become a habitual response to perceived threats and cues, a repeated behavior for a specific reward that led him to abandon the values he’d taught his own children and isolate himself to simmer in the vitriol coming over the airwaves. Senko had another way to describe her dad’s behavior: “He was addicted.”

PUT SIMPLY, SCIENCE agrees that we can get fixated on our own anger; the actual mechanism of this addiction is fascinatingly complex.

When we feel outrage, we’re responding to a potent cocktail of neurochemical reactions, physiological sensations, and conditioned responses. It’s a survival mechanism linked to our deepest, oldest brain system, the limbic system.

Tucker Carlson is fake news!!!

A federal judge dismissed a lawsuit brought against Carlson by Karen McDougal, a former Playboy model who claims to have had an affair with Trump before he became president. In 2018, on his show, Carlson accused McDougal of extorting Trump. She sued him for defamation.

Lawyer Erin Murphy argued for FNC that Judge Mary Kay Vyskocil, a Trump appointee, should toss the lawsuit because Carlson’s show is not news. It is commentary, Murphy said, and so he has no obligation to tell the truth.


Perhaps Fux should be compelled to preface each Tucker Carlson broadcast with "This is NOT the truth, it is merely commentary!!!

Fox News Quietly Paid Kimberly Guilfoyle Accuser Over Sexual Misconduct Claims: Report

Fox News reportedly agreed to quietly pay upward of $4 million to a woman who accused former network host Kimberly Guilfoyle of sexual harassment.

A young woman, who was one of Guilfoyle’s assistants at Fox News, sent company executives a 42-page confidential draft complaint in 2018 that accused Guilfoyle of repeated sexual harassment, according to a New Yorker article published Thursday.

Jane Mayer, who wrote the article, reported in March 2019 that Fox News secretly paid an undisclosed sum to the assistant, who no longer works at the network. Mayer now says that Fox agreed to pay the woman about $4 million to avoid going to trial over a lawsuit.


Fox News did not immediately respond to HuffPost’s request for comment on The New Yorker report.

Guilfoyle was a prosecutor in Los Angeles and San Francisco before becoming co-host of the political talk show “The Five” on Fox News. The network forced her out mid-contract in July 2018, and she now serves as President Donald Trump’s campaign finance chair while dating Donald Trump Jr.

HuffPost first reported in 2018 that Guilfoyle’s departure from the network was not voluntary and that sources said she was terminated following an internal investigation into allegations of inappropriate behavior, such as sexual misconduct. Six sources said that Guilfoyle would show colleagues personal photographs of male genitalia (and identify whose genitals they were), regularly discussed sexual matters at work and would be emotionally abusive toward hair and makeup artists and support staff.

Guilfoyle has maintained that her decision to move from television news to a political campaign was voluntary and that the allegations about her behavior were false. She later threatened HuffPost and other media companies with potential legal action following reports about the sexual harassment claims.

Mayer’s article detailing the former assistant’s draft complaint corroborates HuffPost’s earlier reporting, including that the woman was frequently subjected to degrading, abusive and sexually inappropriate behaviors, such as being shown lewd photographs of men with whom Guilfoyle had sexual relations.

Other instances Mayer cites from the draft complaint are that the assistant was required to work at Guilfoyle’s New York apartment while the network host walked around naked, was forced to listen to Guilfoyle speak incessantly about her sex life, was ordered to give Guilfoyle a thigh massage and was told to submit to a Fox employee’s sexual demands.

The Trump surrogate declined to be interviewed by Mayer but told The New Yorker that she has “never engaged in any workplace misconduct of any kind.” The former assistant has not been publicly identified, and the draft complaint, which was never filed in court, is allegedly covered by a nondisclosure agreement.
