Dear Mr Franzoia,

I am writing in response to the request for public input for the restoration and use of 450 Airport Blvd Burlingame CA.
I desire accommodation made for recreational water access, this includes a beach or wide ramp for non powered vessels to get to the water. I mean windsurfing, kite-boarding, Kayak, Standup Paddle boards. We also require a rigging/ Launching area land side for launching and landing kite- boarders kites. You may not be aware that 300 Airport Blvd. has 7 high rise building in construction just down wind of 450 Airport Blvd. This will impact wind sailing at Coyote point park downwind of these new high rises. To repurpose this 8.8 acres with water access in mind would be very helpful to mitigate the impact of loss of recreational water wind powered water sports from the 300 airport Blvd. buildings.

Please see the mandated water access codified in the California constitution, Federal Coastal Zone Management Act and the Macteer-Petris act. Below.

ACCESS TO THE WATER FOR NAVIGATION HAS CONSTITUTIONAL STANDING IN CALIFORNIA
Section 4 of Article 10 of the California Constitution provides:
No individual ... shall be permitted to exclude the right of way to such water ... or obstruct the free navigation of such water; and the Legislature shall enact such laws as will give the most liberal construction to this provision, so that access to the navigable waters of this State shall always be attainable for the people thereof. (emphasis added)
In any weighing of competing interests in the shoreline, the recognition in the Constitution that navigational access, including access to the shoreline to launch a craft, is a fundamental right must be given great weight.

BOTH THE FEDERAL COASTAL ZONE MANAGEMENT ACT AND THE MACATEER-PETRIS ACT MANDATE INCREASED ACCESS FOR WINDSURFING AND KAYAKING
Section 303(2)(D) of the Coastal Zone Management Act of 1972 calls for states to develop coastal management programs that provide "...priority consideration ... to coastal dependent uses and orderly processes for siting ... facilities related to ... recreation." In California, this provision is implemented through the McAteer-Petris Act, the parent legislation for the regulatory programs of the Bay Conservation and Development Commission. Various policies under that Act apply, including Section 66605, which gives "water-oriented recreation" priority consideration, and Section 66602 that declares that uses such as "water-oriented recreation" are "essential to the public welfare of the bay area." The latter section also includes the legislative finding that "existing public access to the shoreline and waters of the San Francisco Bay is inadequate and that maximum feasible public access, consistent with a proposed project, should be provided. (emphasis added)" This provision must be read in conjunction with the constitutional mandate cited above.
Without doubt, windsurfing and kayaking are coastal dependent and water-oriented recreational uses that warrant priority consideration in planning.”

Dear Al: I read the post at https://www.burlingame.org/news_detail_T19_R44.php with great interest. This post included a request for public input for the restoration and use of 450 Airport Blvd Burlingame CA.

The post reads "This is a site where there could be a large open space area for community use with picnic tables and a restroom. This is one of the last areas in the City where there is an opportunity for a good sized park."

As a local resident, I agree with that view and I believe it would be great to consider use of this area for a park. I believe it would also provide a unique opportunity (only available once) for recreational water access.

Water access includes a beach or ramp allowing non powered small personal craft to get to the water. Examples include windsurfing, kite-boarding, kayaks, standup paddle boards and other recreational craft that allow people to enjoy our precious natural resource, the Bay.

Such water access facilities require almost no extra space. A simple area to park, unload and assemble or rig recreational craft is all that is needed to provide access. For various reasons, mostly large building development, we are slowly losing other viable water access sites (including nearby locations such as Coyote Point).

I know you will be aware of the mandated water access requirements that are codified in the California constitution, Federal Coastal Zone Management Act and the Mcateer-Petris Act.

Thank you for your time and effort on this issue. I just sent a letter to Mr. Al Franzoia as you've advised. Judging from your map, the area in this proposal is just downwind from Kincaids Restaurant in Burlingame. If we can have parking access and a ramp, it would be an excellent location for both windsurfers and kiters to pursue our passion. Plus Kincaids (4 pm Happy hour) is close by so one can enjoy a cold one after a session Smile

Public comments closed April 6th. But this article says you can still write to the state lands commission staff.


Burlingame waterfront property awaits State Land commission decision.

Provided. The Burlingame property at 410 Airport Blvd. is the subject of a number of proposals including one from the city for a park and two from adjacent foreign-owned and Stanford-associated companies.

Burlingame city officials are eyeing a prime waterfront property that they hope could be used to build a park.

For now, the city is locked in a waiting game with the State Lands Commission over the future of the vacant Anza Airport Park at 410 Airport Blvd, located between the Hilton San Francisco Bayfront and Fisherman’s Park. The commission owns the site.

At the Burlingame City Council this week, Mayor Michael Brownrigg expressed support for an open-use park and most of the council shared his vision. Vice Mayor Donna Colson expanded on the idea.

“We have plenty of soccer parks, but if this park offered watercraft access, that would be ideal,” Colson saidl.

But the likelihood of the property being a park is still up for much debate, as witnessed by the packed March 22 meeting about the property’s future.

“The crowd was a mix of Burlingame residents, San Mateo residents, environmentalists from local cities, developers, and union members,” explained Burlingame City Manager Lisa Goldman of the over 100 person crowd.

“The people who attended were very interested in learning about the state’s interest/ownership in the parcel,” said Sheri Pemberton, chief of the external affairs division and legislative liaison for the California State Lands Commission.

She said they were interested in knowing what the “public trust doctrine is.”

The public trust doctrine is a legal concept that requires the government not to erode resources owned by all the public.

According to the commission, the public trust doctrine has always referred to the “basic right of the public to use its waterways to engage in commerce, navigation, and fisheries.” But in recent years, the doctrine has expanded to the right to swim, boat and other water recreation use or even to preserve the land in its natural state for wildlife and the sake of scenery.

But the interested parties might not offer any of those amenities, and that concerned the council.

“What struck me was the commercial uses,” said Colson at Monday’s meeting. “How do warehouses meet the criteria?”

According to staff, the property has offers from H&Q Asia Pacific for a boutique hotel and park on the property, another unnamed hotel developer and the SPHERE Institute, whose headquarters are in the building next to the property.

In October 2015, H&Q Asia Pacific announced its $90 million purchase of the land next to 410 Airport Blvd. According to a press release at the time, the company bought Bay Park Plaza, renamed it GIC Burlingame Bay and intended to build a Global Innovation Center. The two buildings on site include Virgin America’s corporate headquarters. H&Q said they bought the property because it was adjacent to development property that the company purchased with Chinese developers Genzon Property Group in March 2015.

The SPHERE Institute at 500 Airport Blvd. is a not-for-profit policy firm employing Stanford professors. It’s affiliated with the for-profit policy firm Acumen, LLC.

A statement from SPHERE, outlined its plans: “We want the site to be 100 percent public open space, with natural habitat preserved and restored. Our vision includes the possibility of restoring a tidal connection, water access for kayaks and windsurfers, a beautiful continuation of the Bay Trail and ample active and passive open spaces with native landscaping. The bottom line is that we think the state should help us complete the final vision for the site, and our plans will thus remain flexible.”

Attempts to reach H&Q Asia Pacific were unsuccessful, but Pemberton confirmed it remains interested in the property as well, adding, “The public proposed many diverse uses.”

“The public engagement has been fantastic,” said Pemberton. “Our staff looks forward to seeing a future use that provides for active management of the site and encourages a thriving public use and benefit.”

Pemberton said the live public comment closes at the end of the business day on Friday, but added: “The public may continue to comment directly with commission staff.”

The commission is expected to bring a report to the city council in June. In the meantime, residents can send their ideas about what they would like to have developed on the site to the commission.
