Kamala Harris Calls For Formal Impeachment Inquiry Into Brett Kavanaugh
HuffPost HuffPost•September 27, 2019Comment
Quote:

Presidential contender Sen. Kamala Harris (D-Calif.) called for a formal impeachment inquiry into Brett Kavanaugh on Friday in the wake of a new sexual misconduct claim against the Supreme Court justice.

“I write to urge the House Judiciary Committee to take appropriate action to investigate recent reports about Associate Supreme Court Justice Brett Kavanaugh, and to hold Mr. Kavanaugh accountable for his prior conduct and testimony before the Senate Judiciary Committee,” Harris wrote in a letter, dated Sept. 17, to the chairman of the House Judiciary Committee, Rep. Jerry Nadler (D-N.Y.).

Harris, a member of the Senate Judiciary Committee, which conducted Kavanaugh’s confirmation process, announced her call for a formal impeachment inquiry in an essay for Elle Magazine published Friday morning. The senator wrote that the government must investigate whether Kavanaugh lied under oath during his confirmation hearing last year.

Three women accused Kavanaugh of sexual assault or misconduct last year during the justice’s Supreme Court confirmation process

Protesters Air Christine Blasey Ford Testimony Outside Gala For Brett Kavanaugh
Demand Justice set up a massive screen to shame Federalist Society members for honoring the Supreme Court justice accused of sexual assault.

Quote:
WASHINGTON ― Protesters set up a massive video billboard outside of a Thursday night gala honoring Supreme Court Justice Brett Kavanaugh and, for hours, aired Christine Blasey Ford’s Senate testimony on a loop in which she spelled out how Kavanaugh sexually assaulted her in high school.

“We still believe Christine Blasey Ford,” read a line across the top of the screen, which was set up by the progressive judicial advocacy group Demand Justice.

Not really, most of my friends are conservatives, liberals know better than discuss politics with me, because destroying them is pretty easy on most issue.

In deed a mental disorder. I've seen them go from peaceful philosophers to rabid dogs. I lost a couple of great high school friends based on political differences. And it wasn't me who went crazy.

With the FBI testimonies we are finding out that it looks like all the tips about the apparent sexual molester Bret K no one did a thing with these reports and did not investigate a single one or even notify the congress of a single one. Yet it appears there were many, too many.

We need to find out who ordered this. And let the victims of Kavanaugh sexual crimes sue the Epstein trump wantabe..

New Brett Kavanaugh sexual misconduct accusation sets off calls for Supreme Court impeachment

Quote:
At least five Democratic presidential candidates called for Supreme Court Associate Justice Brett Kavanaugh to be impeached after a new report about alleged sexual misconduct from his college years. President Trump, meanwhile, stood by Kavanaugh and said the Justice Department should "rescue" him.

Over the weekend, multiple Democratic presidential candidates, including Elizabeth Warren, Kamala Harris, Julián Castro, Cory Booker and Pete Buttigieg, called for Kavanaugh to be impeached.
Kavanaugh has not responded to the latest report, but previously denied all accusations.

"Last year the Kavanaugh nomination was rammed through the Senate without a thorough examination of the allegations against him," Warren tweeted. "Confirmation is not exoneration, and these newest revelations are disturbing. Like the man who appointed him, Kavanaugh should be impeached."

Harris and Castro both accused Kavanaugh of lying under oath during his Senate confirmation hearings.

In a statement obtained by CBS News, Joe Biden called for further investigation into Kavanaugh and "the truthfulness of his testimony to Senate." "We need to get to the bottom of whether the Trump Administration and Senate Republicans pressured the FBI to ignore evidence or prevented them from following up on leads relating to Justice Kavanaugh's background investigation," the former vice president said.

He also applauded the women who have come forward with accusations against Kavanaugh, saying they "deserve to be treated with dignity and be listened to."

On Saturday, the New York Times published an essay adapted from a book excerpt that claimed one of Kavanaugh's Yale classmates allegedly saw him with his pants down at a drunken dorm party, with friends pushing his penis into a female student's hands, when Kavanaugh was a freshman. According to the essay, the classmate told this story to senators and the FBI, but the FBI did not investigate it.

During Kavanaugh's confirmation process, another Yale classmate, Deborah Ramirez, said Kavanaugh pulled down his pants at another drunken dorm party and thrust his penis at her. She said she swatted it away. The Times essay said it had found additional corroboration for Ramirez's story, with seven people saying they heard about the incident long before Kavanaugh became a federal judge.

On Sunday, the New York Times issued an editors' note that stated an earlier version of the essay "did not include one element" of the book's account of the incident. "The book reports that the female student declined to be interviewed and friends say that she does not recall the incident," the editors' note states. "That information has been added to the article."

The New York Times also deleted a previous tweet that promoted the essay, calling it "offensive."

Buttigieg told CBS News late Sunday that "it's appalling to learn that the GOP curtailed the FBI investigation" and that "[t]he American people deserve to know who was involved ... and we must get answers fast as to why witnesses with key information were not interviewed."

The first public accusation against Kavanaugh last year came from Christine Blasey Ford, a psychology professor. She said that when she and Kavanaugh were in high school, he drunkenly held her down on a bed, groped her, tried to pull off her clothes and covered her mouth when she tried to scream. Kavanaugh said the alleged incident never happened.

Brett Kavanaugh investigation: FBI says it got more than 4,500 tips on Kavanaugh, providing 'relevant' ones to White House

The FBI disclosed that it received more than 4,500 tips on a phone line in 2018 as part of a background investigation into then-Supreme Court nominee Brett Kavanaugh and provided "relevant" ones to former President Donald Trump's White House counsel.

a man wearing a suit and tie: UNITED STATES - SEPTEMBER 27: Judge Brett Kavanaugh testifies during the Senate Judiciary Committee hearing on his nomination be an associate justice of the Supreme Court of the United States, focusing on allegations of sexual assault by Kavanaugh against Christine Blasey Ford in the early 1980s. The exact number of tips was disclosed in a June 30 letter released by Sen. Sheldon Whitehouse on Thursday. The letter was in response to a two-year-old request from Senate Democrats seeking more information about the handling of the investigation.

The revelation reignited fierce accusations from liberals who say that the FBI and the Trump White House did not sufficiently examine allegations against Kavanaugh in the wake of accusations from Dr. Christine Blasey Ford that he had sexually assaulted her at a party in the Maryland suburbs when they were both in high school.

The allegations nearly derailed his confirmation, and Kavanaugh has always fiercely denied them. Kavanaugh was ultimately confirmed by a vote of 50-48.

In the letter, Assistant Director Jill Tyson said that Kavanaugh's nomination was the first time that the FBI set up a tip line for a nominee undergoing Senate confirmation and that the tips included phone calls and electronic submissions.

Tyson said relevant information was provided to the Office of the White House Counsel that served as the requesting entity. Don McGahn served as White House counsel at the time and he did not immediately return a request for comment.

Tyson reiterated comments that FBI Director Christopher Wray made in past congressional testimony: that the FBI serves as an "investigative service provider" for federal background investigations, and that its role in the Kavanaugh matter was to respond to requests from the White House counsel. The FBI has said repeatedly it was not conducting a criminal investigation into Kavanaugh's conduct.

She said that pursuant to a memo of understanding between the Justice Department and the White House in 2010, the FBI does not reopen background investigations unless it is "specifically instructed to do so by the requesting entity."

"The authorities, policies and procedures relied on by the FBI to conduct [background investigations] are not the same as the authorities, policies, and procedures used to investigate criminal matters," Tyson wrote.

The letter prompted a furious response from Whitehouse and six other Democratic senators on the Judiciary Committee.

"The admissions in your letter corroborate and explain numerous credible accounts by individuals and firms that they had contacted the FBI with information 'highly relevant to . . . allegations' of sexual misconduct by Justice Kavanaugh, only to be ignored," they wrote in a letter back to the FBI.

"If the FBI was not authorized to or did not follow up on any of the tips that it received from the tip line, it is difficult to understand the point of having a tip line at all," they said.

A Democratic Senate staffer affiliated with Judiciary Committee acknowledged that the entire universe of tips was provided to senators at the time but that until the letter from the FBI last month, the senators were unaware that the FBI had engaged in a process to determine which tips were relevant. The staffer said that instead of providing the Senate with the FBI's analysis of the relevant tips, the White House sent all the tips to the senators who were only able to read them in a secure room without the benefit of taking notes.

Thursday, Debra Katz and Lisa Banks, attorneys for Ford, released a statement calling the FBI's investigation a "sham and a major institutional failure."

The lawyers said that the FBI had refused to interview Ford and "failed to act on the 4,500 tips it received about then-nominee Kavanaugh."

"Instead it handed the information over to the White House, allowing those who supported Kavanaugh to falsely claim that the FBI found no wrongdoing," they said.

Why the new revelations about the FBI's Kavanaugh inquiry matter
In 2018, Susan Collins said the FBI background check into Brett Kavanaugh appeared to be "a very thorough investigation." We now know better.

Quote:

How reassuring.

The Washington Post's Ruth Marcus, who called the FBI review "laughable," made a compelling case against an incomplete process:

What did then-White House Counsel Donald McGahn do with the "relevant tips?" That, we do know: not a damn thing. McGahn had no interest in discovering what his handpicked nominee had done, or not done. He had every interest in ensuring that Kavanaugh be confirmed, facts be damned. If there was any follow-up within the FBI itself, there's no indication of that. And that is the outrage here. The FBI's investigation into sexual assault allegations against Kavanaugh wasn't designed to uncover the truth.

Donald Trump recently said, in reference to Kavanaugh, "I saved his life. He wouldn't even be in a law firm. Who would have had him? Nobody. Totally disgraced. Only I saved him.... I saved his life, and I saved his career."

It was a curious quote, which is now seen in a new light.

hold public hearing and pull all in rom Barr to trump including FBI people and find out why Americans were not allowed to know about 4500 notifications to the FBI and the FBI did not investigate one of them. Make sure the public hearings are start about 2 months before the midterms so people can be well informed before voting. This way they know how corrupt the republican party is.

Also hold hearings on Epstein and pull in Trump and Barr(Barrs firm represented Epstein, and Barrs father hired Epstein to teach and Epstein did not even have a degree) , and Kenneth Starr who represented Epstein. Find out who erased all the tapes, took him off suicide watch, removed his roommate, again he was in the car of Barr trump justice department. Find out why Trump put in charge of a department the guy who gave epstein a non court approved get out of jail free card and was rewarded by trump with a top government job. Since the idiot attorney general will not do it time for congressional hearings.

The FBI apparently lied about investigating Kavanaugh. What are Democrats going to do about it?

Quote:
The Federal Bureau of Investigation (FBI) has now admitted that it failed to investigate even the most "relevant" of the 4,500 tips it received during an investigation into sexual assault allegations against Brett Kavanaugh, then a Supreme Court nominee, now a Supreme Court justice. That was in response to a two-year-old letter from Democratic Sens. Sheldon Whitehouse and Chris Coons. "We apologize for the extended delay in responding," says Assistant Director Jill C. Tyson.

Which is problem No. 1 for the Senate Judiciary Committee, of which Whitehouse and Coons are members: the FBI and Director Christopher Wray. Wray was the original recipient of the Aug. 19, 2019 letter from the senators. A letter which was ignored until June 30, 2021. Wray was the person ultimately responsible for how the FBI handled the background investigation with that "tip line," which ended up apparently just being a dumping ground. Whitehouse and Coons first pressed Wray on this in a July 2019 hearing.

"During the hearing, Wray echoed Republican claims that the FBI conducted the investigation 'by the book,' while asserting that supplemental background investigations are less rigorous than criminal and counterintelligence investigations," the senators say in a press release following the revelation that the FBI did nothing more than send the tips to Trump's henchmen.

So the senators fired off another letter Thursday. "The admissions in your letter corroborate and explain numerous credible accounts by individuals and firms that they had contacted the FBI with information 'highly relevant to … allegations' of sexual misconduct by Justice Kavanaugh, only to be ignored," the senators write in a sternly-worded letter. "If the FBI was not authorized to or did not follow up on any of the tips that it received from the tip line, it is difficult to understand the point of having a tip line at all." The letter demands more answers, potentially in pursuit of what will possibly be a future oversight investigation by the Judiciary Committee.

Because if it's not, what the hell is the point? There has to be accountability from Wray to explain why exactly the Trump White House called the shots on this. Honestly, Wray's job needs to be in jeopardy here. There's the very real possibility that the FBI director lied to the Senate Judiciary Committee in July 2019 when he told the senators that the investigation into allegations against Kavanaugh were "by the book." The committee needs to put all of the heat they can muster on him, and if necessary, on his boss—Attorney General Merrick Garland—until they get some goddamned answers. That goes for all the questions Whitehouse raised in a follow-up demand to Garland in March of this year.

In his follow up letter to Garland, Whitehouse wrote: "If standard procedures were violated, and the Bureau conducted a fake investigation rather than a sincere, thorough and professional one, that in my view merits congressional oversight to understand how, why, and at whose behest and with whose knowledge or connivance, this was done." This follow-up letter to Garland is apparently the impetus for the FBI to dust off its inbox to find and respond to the original inquiry from 2019, but it certainly doesn't answer all of their questions.

While they're at it, Senate Democrats need to start probing again how Kavanaugh managed to pay off hundreds of thousands in credit card debt between May 2017 and his nomination in July 2018, and on top of that pay $92,000 in country club fees, and pay the $10,500-a-year tuition for his two kids in private school, and make payments on the $815,000 mortgage he had for his $1.2+ million home. Because all of that is still very, very hinky.

That leads us to problem No. 2 for Senate Democrats and for President Joe Biden. There is a seated Supreme Court justice who has been credibly alleged to have committed assault, who has not been investigated, and whose finances are questionable, to say the least. First, this:

There is nothing stopping Democrats in the House and/or Senate from interviewing the witnesses the FBI never spoke to, and collecting the FBI tips the Trump White House apparently buried, as part of its own investigation into whether Kavanaugh committed perjury.

— Brian Fallon (@brianefallon) July 22, 2021
That's from a former senior aide to Majority Leader Chuck Schumer, former Justice Department staff, and now executive director of Demand Justice. So yes, Congress can most definitely conduct the investigation where the FBI failed. The results of these investigations could lead, potentially, to impeachment of Kavanaugh, though that's a long shot and potentially a long way away.

Right now, Kavanaugh is just one of three Trump Supreme Court justices who are there in the most dubious of circumstances. Neil Gorsuch is in a seat stolen from President Barack Obama (hey, Merrick Garland!) by Mitch McConnell. Kavanaugh was not property vetted, no matter how you look at it. Amy Coney Barrett was rushed onto the court just days before the 2020 election—while people were casting their ballots—because Trump thought she would give him the majority that would overturn the election in case he lost. This dubious trio joins the inarguably corrupt Clarence Thomas, whose wife Ginni spent the whole of 2020 amplifying Trumpist conspiracy theories about Biden on social media.

They, with Alito, are the Supreme Court majority. The ones who all but ended voting rights and allowed for even more secrecy in dark money to flood our system. What they have planned for next session is even worse. The Supreme Court is packed with dangerous ideologues, and a few corrupt ones, too.

Now President Biden and Democrats have a chance to, well, unpack it. To dilute the Trump/RNC/Koch/Federalist Society’s malign influence and balance it out with four or six or however many additional justices. It is imperative. It is existential.

In the September 19 "New Yorker" we learn how Brett was raised as a man of the people. His father, E. Edward Kavanaugh, was a lobbyist for the Cosmetic, Toiletry, and Fragrance Association, earning an annual salary package of four and a half million dollars. That's right, working hand in hand with the paid whores for the tobacco and oil industries, keeping the world safe for business to peddle cancer-causing products. No wonder he is entitled.
