Trump's former personal lawyer, Michael Cohen, pleaded guilty last year to charges that the payoffs amounted to illegal campaign contributions.

Trump, who has denied the affairs, said he never directed Cohen to do anything illegal.

The Democratic-controlled committee is considering as a potential witness David Pecker, chairman and chief executive of American Media Inc, the publisher of the National Enquirer tabloid newspaper.

AMI admitted in a non-prosecution agreement with federal prosecutors that it made a $150,000 payment to McDougal “in concert” with Trump’s presidential campaign.

“No campaign violations were engaged in by the president,” said Jay Sekulow, a lawyer for Trump, the Post reported.

The White House could not immediately be reached for comment.

Michael Cohen, the former personal attorney for President Donald Trump, has entered into an agreement with New York City prosecutors to provide information about the president's business operation, a source familiar with the situation told NBC News Wednesday.

The Manhattan District Attorney's office is investigating the possibility that the Trump Organization falsified business records, the source said.

Representatives from the District Attorney's office reportedly met with Cohen on Aug. 20 at Otisville Prison, in upstate New York, where he's serving a three-year sentence. Proffer agreements allow defendants and suspects to provide information to prosecutors without incriminating themselves.

The penalty for those found guilty in a tax fraud case, according to former U.S. attorney Joyce Vance, is not insignificant. "If it's a tax charge, which we don't know... we could be looking at a lengthy violation for a felony. It's certainly not a misdemeanor... There is the threat of jail time."

NEW YORK — A Bronx trial judge on Friday ordered President Donald Trump to provide videotaped testimony for an upcoming trial over a lawsuit brought by protesters who say that his private security guards assaulted them on a public sidewalk in front of Trump Tower and stole a protest sign.

The ruling raises the highly unusual constitutional spectacle of a state-level judge commanding a sitting president to testify for a trial against his will. But Justice Doris Gonzalez of the Bronx Supreme Court wrote that Trump’s testimony was necessary, rejecting a request by his legal team that she quash a subpoena. The trial is scheduled to start on Sept. 26.

“More than 200 years ago our founders sought to escape an oppressive, tyrannical governance in which absolute power vested with a monarch,” Gonzalez wrote. “A fear of the recurrence of tyranny birthed our three-branch government adorned with checks and balances.”

“No government official, including the executive, is above the law,” she added.

The dispute centers on a protest in September 2015 in front of Trump Tower in Manhattan, during Trump’s first presidential campaign. Five plaintiffs in the lawsuit were protesting in front of the building. Two were dressed in attire mimicking Ku Klux Klan robes. Others carried large campaign-style signs saying, “Make America Racist Again.”

In an ensuing confrontation, some parts of which were captured in videos, Trump’s private security detail inaccurately told the protesters that the sidewalk in front of Trump Tower was private property and tried to force them to move away from it.

Trump’s security director at the time, Keith Schiller, who later had a stint in the White House as an aide to Trump, ripped away two of the large protest signs and tried to carry them into the building. When one of the protesters, Efrain Galicia, pursued him and grabbed one of the signs, Schiller struck him in the head, video shows.

Gonzalez noted that the Supreme Court ruled in 1997 that presidents did not have temporary immunity for acts that were done before taking office and were not related to their official duties. In that matter, a federal lawsuit by Paula Jones against President Bill Clinton, Clinton ultimately submitted to a deposition, but the case never went to trial.

Friday’s ruling also pointed to one from a New York appeals court in March that rejected a claim by Trump’s legal team that, as president, he was immune from state lawsuits under the Constitution. That ruling has permitted a defamation suit — from a former contestant on “The Apprentice” whom Trump called a liar after she accused him of groping her — to proceed.

The Enquirer never published her story.

“The staffer opened the safe, removed a set of documents, and tried to wrest it shut,” Farrow writes. “Later, reporters would discuss the safe like it was the warehouse where they stored the Ark of the Covenant in Indiana Jones, but it was small and cheap and old.”

Shortly before the 2016 presidential election, Americans heard a recording in which Donald Trump was heard bragging about committing sexual assaults. The Republican said, among other things, that he kisses women he considers attractive – “I don’t even wait,” Trump claimed at the time – which he said he can get away with because of his public profile.

“When you’re a star, they let you do it,” Trump said on the recording. “You can do anything. Grab ‘em by the p—y.”

After Trump denied having done what he bragged about doing, more than a few women came forward to accuse the Republican of sexual misconduct – one of whom, Summer Zervos, is currently suing the president for defamation, after Trump insisted each of his accusers were liars.

Trump and his lawyers have spent months trying to make the case go away, insisting that a sitting president is immune to civil suits in state courts. As regular readers know, their efforts have come up short and the case is ongoing.

The Washington Post reported overnight on the latest revelations from the case.

Excerpts of President Trump’s private calendar from a dozen years ago made public on Thursday appear to show Trump was at a Beverly Hills hotel around the same time a former “Apprentice” contestant alleges he assaulted her there.

Email exchanges from 2007 also released Thursday show that the woman, Summer Zervos, had sought a lunch meeting with Trump in New York around the time she claims he kissed her inappropriately in that city.

The calendar records and email correspondence came to light in court filings related to Zervos’s ongoing defamation lawsuit against Trump in New York State Court.

Trump has denied any wrongdoing, insisting he never met Zervos at the Beverly Hills Hotel. The president’s lawyer in this case, Marc Kasowitz, told the Associated Press yesterday that Zervos’s claims are “entirely meritless and not corroborated by any documents.”

Nevertheless, the latest details emerged as part of the discovery process in this case, and that process is ongoing. That’s of interest for reasons that relate directly to the defamation suit, of course, but there may be related implications.


As we’ve discussed before, Zervos’ representatives have raised the prospect of seeking, among other things, documents from the Trump Organization about the president’s alleged mistreatment of other women, as well as recordings from the archives of the president’s former reality show.

The Post’s report added that a judge has set a Dec. 6 deadline for depositions, “meaning Trump may have to make a statement or answer questions under oath.”

That may be right around the time of the president’s impeachment in an unrelated scandal.

Zervos contacted lawyers about the allegations in 2011 and reached out to Fox News about the matter in August 2015, according to a new filing from her lawyers.
The California-based restaurant owner, who is a Republican, is suing Trump for defamation after he essentially called her a liar following her public statement in October 2016 about the alleged assault.
"The fact that plaintiff sought legal counsel in 2011 and spoke about this to others including a news organization -- years before the events of 2016 at issue in this case -- strongly supports the inferences that her core narrative is true," states the filing from Zervos' lawyer Mariann Wang. The filing cites emails and calendar entries to back up the claim.
Trump has denied assaulting Zervos.
Wang notes that Zervos reported Trump's alleged sexual assaults to family members and close friends immediately after they occurred and then again over the years and considered taking legal action years before.
She also "reached out to multiple lawyers back in 2011, including to Gloria Allred, whose records reflect that contact," Wang writes. Allred represented Zervos at the time of her October 2016 news conference at which she first accused Trump of sexual assault, but later stepped away from the case.
The filing includes an email to Fox News dated August 9, 2015. In it, Zervos writes Trump acted inappropriately towards her.
"I was on the Apprentice. After the show was completed, Trump invited me to a hotel room under the guise of working for him. He had a different agenda. Please contact me to speak further as I have tried to make contact," the email states, under the subject line "Trump Hit On Me."

Wang also argues that Zervos' account has been corroborated "in close detail" by documents produced from Trump's own files during the discovery process -- specifically calendar entries and itineraries from late 2007 through early 2008 -- the period during which Zervos says she met with and was assaulted by Trump. Wang says these documents "line up with Zervos' detailed public account with striking accuracy."
For instance, Wang says Trump's calendar shows him flying from Las Vegas to Los Angeles with his bodyguard Keith Schiller and staying at the Beverly Hills Hotel in Los Angeles on December 21, 2007 -- the same night Zervos says she met him there.
Zervos also points to emails exchanged with Trump's assistant Rhona Graff regarding a visit she made to New York and a hard copy of a New York Times from December 2007 that she says Trump gave her, as evidence of their interactions.
Trump's lawyer rejected Wang's argument in the new filing.
"Ms. Zervos' claims are entirely meritless and not corroborated by any documents," said Marc Kasowitz, founding partner of Kasowitz Benson Torres LLP.
Ongoing discovery dispute
Wang argues that despite Trump's claims that there was "no truth" to Zervos' allegations, "he has now been forced to produce documents from his own files confirming that he and Plaintiff were exactly where she said they were exactly when she said they were there."
The Trump Organization previously declared these documents "confidential" and only after months of legal wrangling and a recent telephone conference with the court did Trump and the Trump Organization "finally and begrudgingly agreed to lift a number of these baseless designations," according to the filing.
The two sides are now in a dispute over additional documents. Wang says the Trump Organization has improperly designated nine pages of records as "confidential" because they contain the President's former cell phone number.
"That argument is nothing short of absurd given that Defendant no longer uses that number and, indeed, himself publicized it to his millions of Twitter followers during the 2016 campaign," the filing states.
Wang believes the documents the Trump team is withholding will corroborate Zervos' account "with even more granularity and with a degree of precision that plaintiff could not have known were she not telling the truth." However, Wang's elaboration in the subsequent paragraphs is redacted, given the current dispute over confidentiality.

More than a decade ago, Donald Trump made phone calls from his cellphone to a former candidate on “The Apprentice” around the same time that she says he sexually assaulted her, according to phone records made public Tuesday.

The excerpts from Trump’s Verizon cellphone bills over a three-month period in 2007 and 2008 show that Trump exchanged calls with Summer Zervos on at least six occasions, including on a day that Trump’s private calendar has shown that he was staying at the Beverly Hills Hotel.

According to Zervos’ version of events, it was at the Beverly Hills Hotel that Trump forced himself on her, allegedly groping her in a hotel room.

The president’s lawyers have repeatedly denied the allegations.

According to Zervos’ lawyer, the phone records corroborate her account “of the sexual assaults with even more granularity and with a degree of precision that [Zervos] could not have known were she not telling the truth about those interactions when she spoke publicly about them before this case was filed.”
