Lawless Presidents Will Victimize U.S. If Trump Isnt Held To Account, Warns George Conway

Conservative, anti-Trump attorney George Conway warned that Donald Trump must suffer the consequences of his acts, or the nation is doomed to be victimized by presidents unrestrained by the law in the future.

Conway, the husband of Trumps former White House Counsel Kellyanne Conway, presented a lengthy examination in an op ed piece in The Washington Post of Trumps suspected misconduct and even possible criminal behavior in a variety of actions in the White House and before his presidency.

They include suspected campaign finance violations and possible collusion in the 2016 election with Russia (Robert Mueller did not exonerate the president, despite what Trump has claimed, noted Conway). There may still be significant fallout from Trumps strong-arming of Ukraines president to go after political rival Joe Biden, which led to Trumps first impeachment, and tax and business conduct being investigated by Manhattan District Attorney Cyrus Vance Jr., Conway warned.

Particularly troubling was Trumps post-election behavior, Conway noted. Fear of indictment for past crimes seemed to animate Trumps frenzied efforts to overturn the results of the election he so clearly lost and retain the protections of the presidency, he added.

A desperate fear of criminal indictment may even explain Trumps willingness to break any number of laws to stay in office despite losing his reelection bid democracy and the Constitution be damned, Conway wrote. Trump even insisted to Georgias secretary of state in a stunning recorded phone call to find enough votes for him to overturn the states actual election results.

Then, as the clock wound down on his time in office, he committed the ultimate impeachable offense for a president: fomenting a violent attempted putsch at the Capitol to stop Congress from confirming President-elect Joe Bidens electoral victory, Conway wrote.

If there could be any doubt about whether Trump can be given a pass without the rule of law paying too high a price, that ended in the ugly final weeks of Trumps presidency, Conway added. His attempts to reverse a free and fair election by any means he saw necessary, including by fomenting violence have not only undermined the rule of law but also threatened to destroy it altogether. No other president has ever done that, or attempted to do that, or probably even thought of doing that. Not even Nixon.

Trumps post-election conduct makes it impossible for the Justice Department to look away, noted Conway. If prosecutors dont investigate and, if warranted, charge, this former president, then we might as well say that all presidents are completely immune from criminal consequences for their conduct whether during their term or after; whether the conduct occurred before their presidency or while in office, Conway added.

We might as well say, flat-out, that presidents are above the law.

It doesnt matter that Sands left her job last month. The federal agency that investigates allegations of federal employees using their platform to engage in politics reported to Biden last week that her tweets ran afoul of the 80-year-old Hatch Act.

The Office of Special Counsel is investigating more than a dozen allegations of Hatch Act violations against high-profile Trump appointees even though they left office before Biden was sworn in as president, according to four people familiar with the cases.

Thats put Biden in a bind. Hes eager to move on from the investigations of the previous administration after Trumps second impeachment trial cast a shadow over the first few weeks of his presidency. But House Democrats and government watchdog groups say its important to hold past officials accountable for their actions, arguing it will help prevent similar behavior in the future.

Sands, a former socialite, B-list movie star and chiropractor, unwittingly found herself in the spotlight after Trump started musing about trying to buy Greenland from Denmark. Her repeated re-tweeting of partisan news stories may have made her among the less discrete figures from the Trump era to be accused of violating the Hatch Act. But there were many others.

Most of them, including former Education Secretary Betsy DeVos, Trumps daughter and son-in-law, Ivanka Trump and Jared Kushner, who both served as White House advisers, and former White House press secretary Kayleigh McEnany, are accused of promoting Trump on TV or Twitter. Others are accused of engaging in politics during the Republican National Convention and on Election Day when political events were held at the White House.

The Hatch Act matters because our public servants must serve all Americans, not be a concierge service for crooked politicians, said Rep. Bill Pascrell (D-N.J.), who requested one of the investigations and expects to introduce a bill strengthening the Hatch Act in the coming weeks. The Trumps regimes assault on the rule of law has crushed public trust in government that must be restored.

The White House is reviewing the report about Sands, according to an official. Neither Sands, a major Trump donor who is weighing a campaign for Senate in Pennsylvania, nor her attorney responded to messages. In a written response to OSC, Sands attorney states that they disagree with the agencys legal analysis and conclusions.

The White House did not address the other outstanding investigations. But the OSC has penalties it could administer and Biden and fellow Democrats have several options available too. The president could ban former federal employees who violate the Hatch Act, including Sands, from serving in the federal government again or if they tried to return in a future administration, the Senate could hold up their confirmation or the oversight agency could pursue additional penalties.

The subpoena issued to the New York City Tax Commission is the latest indication that Manhattan District Attorney Cy Vance Jr. is looking at the values Trump assigned to some commercial properties in tax filings and loan documents.

Along with information already subpoenaed from creditors, the tax agency documents would help investigators determine whether Trumps business inflated the value of his properties to secure favorable terms on loans while deflating those values to lower tax bills for those same properties.

New York City Tax Commission President Frances Henn confirmed the subpoena in response to an inquiry from Reuters.

The subpoena likely would compel the agency to provide detailed income and expense statements the Trump Organization would have filed as part of an effort to lower tax assessments on some of its commercial properties, according to people familiar with the commissions operations. Trump's holdings include Trump Tower and Trump Plaza.

Those filings typically would include valuations submitted by the company to challenge the market values assigned to Trumps property by the citys tax assessors, they added.

Subpoenas also have been issued to at least two creditors that helped finance Trumps real-estate holdings, Deutsche Bank AG and Ladder Capital Finance LLC, Reuters has previously reported.

NY attorney general fires back at Trump's defense of financial statements

(Reuters) - New York's attorney general on Wednesday pounced on former President Donald Trump's defense of company's financial statements, saying the five-page statement Trump issued a day earlier contradicted a court filing by his attorneys.

"It is not unusual for parties to a legal proceeding to disagree about the facts," the attorney general's office wrote in a letter filed in New York state court. "But it is truly rare for a party to publicly disagree with statements submitted by his own attorneys in a signed pleading -- let alone one day after the pleading was filed."

Attorney General Letitia James is conducting a probe into whether the Trumps inflated real estate values to obtain bank loans, and reduced values to lower tax bills.

Trump's attorneys repeatedly stated that he did not know enough to respond to allegations of inaccurate valuations. But the former president's five-page statement got into detail about possible discrepancies, implying that he had more knowledge than his lawyers said.

On Monday, the attorney general's office made public a Feb. 9 letter from Trump's longtime accountant, Mazars, which said the Trump Organization's financial statements for 2011 through 2020 should no longer be relied on and that it would no longer do work for the former president's New York-based real estate business.

On Tuesday, Trump issued a five-page statement disparaging the attorney general and other New York officials, calling the investigation a political and racist attack, claiming Mazars had essentially been forced to resign, and defending the financial statements.

"Remember when the attorney general and or District Attorney say they think my financial statements may be high, I don't even include these branding numbers in them, which is far more than any discrepancy they may have," Trump wrote.

Instead of the "sham investigation" of his business, Trump said in another part of the five-page diatribe, law enforcement and the "fake news media" should look into former U.S. presidential candidate Hillary Clinton as well as "murderers, drug dealers and rapists."

In a court filing on Monday in response to the attorney general's allegations of misleading financial statements, Trump, through his attorneys, repeatedly denied he had knowledge or information to form a belief as to the claims.

The attorney general is seeking testimony from Trump and two of his adult children, Donald Trump Jr. and Ivanka Trump, as part of her civil probe of the company's business practices.

Justice Arthur Engoron in New York state court in Manhattan will hear arguments on Thursday on whether subpoenas for the testimony should be enforced.

A separate but overlapping criminal case involving the company's business practices is being conducted by the Manhattan District Attorney, which the attorney general joined in May.

In addition to signing off on Mr. Trump’s statements of financial condition, which were used mostly when seeking bank loans or other credit, Mazars also prepared his tax returns, though the firm did not raise doubts about those in its letter.

Intentionally filing false tax returns with the government is a criminal offense, and there has been no indication that prosecutors are pursuing that avenue. As such, Mr. Trump’s tax filings have long been considered perhaps the most accurate portrayal of his financial condition.

The New York Times in 2020 obtained decades of tax return information for Mr. Trump and his companies, which revealed that for all his claims of stellar business acumen and high net worth, he actually lost money in many years, had huge bank loans coming due and faced a long-running I.R.S. audit that could cost him $100 million. He often paid little or no federal income taxes.
In fact, Mr. Trump’s tax returns add some important context to the 2014 financials by Mazars that he included in his statement Tuesday night, which painted a rosy picture of Mr. Trump’s wealth. That year, his income from “The Apprentice” and licensing deals was in a steady decline, and he was selling off stocks to help finance the purchase of a Scottish golf course and to open a hotel in the Old Post Office building in Washington, D.C., projects that would turn out to be money losers.

His bottom line for the year: $47 million in losses on his core businesses and zero federal income tax.
