WASHINGTON — Dramatic, newly released video shot by a Jan. 6 rioter shows the confrontation between two Republican members of Congress and Capitol rioters trying to breach the main door into the chamber of the U.S. House of Representatives. The videos show rioters staring down the barrels of guns through broken glass as they tried to force their way inside.


The 8-minute video, shot by Capitol rioter Damon Beckley and introduced as evidence ahead of his sentencing, was released to the media coalition late Friday in response to a request from NBC News. Federal prosecutors are seeking more than three years in federal prison for Beckley, and his sentencing has now been rescheduled for Feb. 9.

Rep. Troy Nehls, R-Texas, and Rep. Markwayne Mullin, R-Okla., can be seen speaking with rioters through the broken glass.
"You ought to be ashamed of yourself!” Nehls says.

“We’re coming in one way or another!” one rioter says.

"I’ve been in law enforcement in Texas for 30 years, and I’ve never had people act this way," Nehls says. "I’m ashamed!"


Nehls has changed his tone in the three years since Jan. 6, even calling the death of Ashli Babbitt — the rioter who was shot by a Capitol Police officer as she jumped thrthe House floor — "murder." In a previous interview with Nightly News, Nehls explained his thinking on Jan. 6.


"I am going to stay right here with my brothers and sisters in blue," Nehls said. "I had my Texas mask on, and he looked at me through that broken glass and he said 'You're from Texas, you should be with us,' and at that point, I said 'No, sir, I cannot support what you're doing, this is criminal.'"

In the video, one rioters tell the officers and representatives on the other side of the door "there’s going to be a bigger Civil War and a lot of bloodshed" if they didn't get overturn the election.

“I drove fourteen hours to get here and stood in the cold for three and a half hours to find out that Mike Pence is a f------ traitor, man. And I voted for that f------ dude,” Beckley says in the video. “He could’ve done the right thing and certified those legislators, electors, and we wouldn’t be standing here with a nine-millimeter pointed at me right now!”

“We’re real American citizens, and we’re sick of this," another rioter says. "We’re making it known that we’re sick of it.”

“They can only kill so many of us," says one rioter.

A significant portion of the information in the report comes from interviews with Dan Scavino, Trump's former deputy chief of staff and current senior adviser to his reelection campaign. Scavino, who refused to cooperate with the House select committee's probe on Jan. 6, citing executive privilege, had his claims rejected by a judge last year and was informed he had to comply with a grand jury subpoena. Essential parts of his testimony were disclosed to ABC News.
Other White House advisers and top lawyers also spoke with Smith’s team, providing new details about Trump’s statements and demeanor on Jan. 6, 2021, the news outlet reported.

The report describes a president “shockingly derelict” in immediately intervening to stop the “most serious invasion” of the Capitol by domestic terrorists in the nation’s history, Bennett Gershman, a former New York prosecutor and law professor at Pace University, told Salon.

Scavino informed Smith's investigators that as the violence intensified on Jan. 6, Trump showed little interest in taking further action to curb it, sources told ABC News.

“Trump was ‘very angry’ that day – not angry at what his supporters were doing to a pillar of American democracy, but steaming that the election was allegedly stolen from him and his supporters, who were ‘angry on his behalf,’” ABC News reported. “Scavino described it all as ‘very unsettling,’” sources told the outlet.

The ex-president would occasionally sit silently at the head of the table, arms folded, and gaze fixed on the TV, Scavino said, according to sources.

While speaking with Smith's team, Scavino recalled telling Trump in a phone call the night of Jan. 6: "This is all your legacy here, and there's smoke coming out of the Capitol," sources told ABC News. Scavino said he hoped Trump would ultimately help lead a peaceful transfer of power.


Former Trump aide Nick Luna also shared that when the ex-president was told about Vice President Mike Pence’s need to be moved to a secure location, Trump responded by saying "So what?" Luna perceived this as an “unexpected willingness” on Trump's part to expose a longtime loyalist to potential harm.

“Indeed, Trump’s angry response to Scavino’s comment to him that there’s smoke coming out of the Capitol in effect was, ‘Let it Burn,’” Gershman said. “And his nonchalant indifference to Vice President Pence’s safety and welfare offers chilling proof that Trump’s conscious purpose, namely, his intent, was first to incite an insurrection and then by his inaction to demonstrate his intent that the insurrection effectively stop Congress from doing its constitutional duty to certify the election results.”

This proof would be “powerful circumstantial” evidence of Trump’s criminal intent underlying all the federal charges, he added.

Temidayo Aganga-Williams, white-collar partner at Selendy Gay Elsberg and former senior investigative counsel for the House Select Committee to Investigate the January 6th Attack, agreed that Trump’s refusal to intervene could be used by Smith to show his criminal intent on the day of the attack because Trump agreed with the violence and hoped that it would succeed in preventing the transfer of power.

“Trump’s decision not to act undercuts any argument that he was acting in good faith – even if he legitimately believed he won the election (which he did not), his decision to let violence go unimpeded helps show that he endorsed criminal obstruction of the Congressional proceeding and that the rioters’ actions were consistent with Trump’s goals,” he added.

In the extensive indictment against Trump, Smith accuses the former president of attempting to unlawfully cling to power by "spread[ing] lies" about the 2020 election and pressuring Pence to obstruct Congress from certifying the results on Jan. 6. Trump has pleaded not guilty to all charges.

The report indicates several instances when Trump’s inner circle tried to intervene and convince the ex-president to call off his supporters from rioting on January 6. But instead of releasing a statement that would put an end to the violence, Trump instead posted a message on his Twitter account further fueling it.

Pence "didn't have the courage to do what should have been done," he tweeted. The message shocked his closest aides, with some even telling him that a public attack on Pence was "not what we need," sources told ABC News.

“It seems that as Smith’s prosecution team keeps building its case with dramatic new proof, the case appears to be so gaining momentum and appears to be so overwhelming that reluctant or scared witnesses might decide to cooperate and avoid getting themselves entangled in the case as defendants,” Aganga-Williams said.

The legal consequences establish “overwhelmingly Trump’s evil intent to undermine constitutional democracy,” Gershman said. Through his lack of action in failing to prevent the riot and going against his aides' pleas for intervention, Trump “demonstrated a criminal intent" to collaborate with the insurrectionists to protect his own political survival at the "expense of the constitution and democracy.”

Trump announced in effect, “Let the constitution and democracy burn down,” Gershman said.

This is particularly embarrassing for D'Souza, who repeatedly cited True the Vote's purported research when asked to defend flaws in his movie's claims about widespread ballot fraud.


In fact, D'Souza at one point told Bump in the 2022 interview that True the Vote could provide him with direct evidence of voter fraud that, it turns out, the group never had.

Commenting separately on Twitter, Bump wrote of "2,000 Mules" that "the whole thing was obviously a hustle."

However, Trump’s legal team had envisioned an alternative scenario—one that would have prolonged the period of uncertainty caused by the Trump campaign’s efforts, stretching the process until Jan. 20, 2021, the Constitution’s firm deadline for the transfer of power. If their plan had succeeded, these lawyers hoped that Joe Biden would never assume office.

The specifics of this plan are now being disclosed for the first time. They are derived from a collection of documents provided to Michigan prosecutors by Trump’s lawyer Kenneth Chesebro, which includes thousands of pages of emails exchanged among Trump’s legal team, some of which contain previously unpublished information.

Trump’s lawyer Chesebro developed strategies to create confusion and disorder by exploiting the procedures outlined in the Electoral Count Act (ECA), which governs the Congressional certification process. Specifically, he devised multiple methods to undermine the ECA, the legislation that outlines the steps for Congress to certify the election on Jan. 6. Crucially, the law imposes strict constraints on the duration of individual lawmakers’ debates over contested electoral votes—changing or extending these limits, set at five minutes per member and two hours in total, could extend Jan. 6 indefinitely.


The detailed plan involved using objections from Republican lawmakers to challenge Biden’s victory. TPM obtained a collection of documents from Michigan prosecutors in Attorney General Dana Nessel’s (D) office, who received records from Chesebro as part of his cooperation with their investigation into the fake electors. Chesebro provided emails, texts, a 4.5-hour interview, and legal memos to prosecutors. These records do not fully outline the Trump campaign’s entire endeavor to overturn the President’s loss; they represent what Chesebro shared to mitigate further prosecution.

At one point, Chesebro speculated on whether “legal giants like [Sen. Ted] Cruz and [Sen. Mike] Lee would back” the effort and suggested that Senators might filibuster the five-minutes-per-member rule to extend the debate indefinitely. Such delay tactics, Chesebro hoped, would “force serious review” of the fraud allegations in Congress.

He laid out the argument in a Jan. 1 email with “KEY: Critical that a senator object to the concurrent resolution on Jan. 3” as the subject line sent to Epshteyn and Eastman.

“After all, the main REASON to oppose adoption of the Concurrent Resolution, limiting debate to just 2 hours on each state, is that THERE IS SO MUCH TO DEBATE!” Chesebro wrote. “And the way to make that case is to lay out evidence of all the problems in these various states.”

He contended that removing the ECA would open the door to unlimited filibusters on Jan. 6, or allow Pence to carry out their other directives. According to Chesebro, Sens. Josh Hawley (R-MO), Cruz, Lee, and others could lead an ongoing debate highlighting the Trump campaign’s claims of fraud.

The documents outline various strategies to nullify the ECA. One approach considered was having then-Vice President Mike Pence challenge the acceptance of Biden’s electoral votes, creating a legal grey area that would spark lengthy disputes. Another proposed option was filing a “test case” before the Supreme Court, led by Sen. Chuck Grassley (R-IA), questioning the constitutionality of the ECA. Additionally, Chesebro suggested using the Senate filibuster as a blunt instrument to block the ECA, potentially leading to indefinite delays.
