I think you might be buying a cool-aid if you think that the fee is a tool to ease congestion.

The city is developing a luxury Island, in the same way that it let a luxury China Basin/South of Market develop, and kind of forgot to collect taxes from Facebook, Google, Huber etc ...

Developers will make literally billions at TI, and the fee is not only a slap in the face (why don't they pay for a ferry?) but it makes sure that the luxury Island becomes as gated as possible.

A republican administration could not do better! Good luck trying to reduce the fee for ... windsurfers ...

Great showing of about 35+ windsurfers, kiters and wingers at tonight's remote informational meeting. Big shout out to everyone, and in particular Mac and Andrew Sullivan who spoke on behalf of the SFBA and over 4,000 + boardsailors, for creating momentum to carry us to next meeting before the TIMMA committee meeting on Thursday, December 9, 2021 at 3:00 p.m., and what may be a pivotal meeting of the Treasure Island Mobility Management Agency Board, chaired by Supervisor Haney, on Tuesday, December 14, 2021 at 9:30 a.m. The meetings are virtual, so easy to attend.

If someone schools me on how to attach PDF's (apparently not an allowed extension?), I can post the San Francisco Bay Conservation and Development Commission's letter of November 15, 2021, and the SFBA's letter of November 16, 2021. While the letters are strong, we shall only prevail on having access at TI and elsewhere in the Bay if we show up.

It's a little tricky to find without a targeted search. The relevant section is quoted in the SFBA letter, but I read the whole thing, and the section on Recreation to see if they had put some weasel words in. Didn't find any--which is why I asked them if they had relied on this document to clear their proposed action. Each subsequent action by TIDA needs to either rely on the FEIR (and thus be consistent with it), or develop different CEQA findings. Since adverse impacts on recreation are generally seen as significant impacts, this triggers a new round of CEQA. Something neither the City nor the developer want, if they had actually thought it through.

There is a separate line of legal attack because there is no adverse impact (or only a tiny one) that allows imposition of a fee. While they have a piece of legislation that allows them to establish a transportation program with congestion management, it doesn't exempt them from any other requirement. The law is pretty much short and sweet--it allows, but doesn't pre-empt.

For your information, the new City Attorney used to be a BCDC Commissioner. It couldn't hurt to reach out to him.

Not a lawyer, but played one on TV.

Going back to the above, it appears that, like I had thought (but didn't know), that AB 981 already "authorizes the Board of Supervisors and the San Francisco County Transportation Authority, ... , to adopt a congestion pricing program for Treasure Island and Yerba Buena Island" (Final EIR IV.E.25).

True as far as it goes. But it doesn't exempt them from any of the other legal requirements. Keep watching, more will be revealed.
