Summer Zervos' lawsuit against President Donald Trump can proceed, court rules

Summer Zervos, a former contestant on The Apprentice, can proceed with her defamation lawsuit against President Trump, a New York appellate court ruled Thursday, rejecting the president’s assertion he cannot be sued in state court.

The decision means the president may have to sit for a sworn deposition, which is currently scheduled for June.

The New York State Appellate Division’s First Department turned down Trump’s argument that the case should be halted until he is out of office because, as a sitting president, he was immune from a lawsuit brought in state court.

“We reject defendant President Trump's argument that the Supremacy Clause of the United States Constitution prevents a New York State court - and every other state court in the country - from exercising its authority under its state constitution,” the judges wrote. “Instead, we find that the Supremacy Clause was never intended to deprive a state court of its authority to decide cases and controversies under the state's constitution.”

Zervos was among 19 women who publicly accused Donald Trump during the 2016 campaign of sexual misconduct dating back years earlier. He denied the allegations and called the women liars, which prompted Zervos to sue for defamation.

(MORE: Summer Zervos demands information on other Trump accusers for defamation suit)

“We are very pleased that the First Department has affirmed once again that Defendant is not above the law,” Zervos’ attorney Mariann Wang said in a statement. “We look forward to proving to a jury that Ms. Zervos told the truth about Defendant’s unwanted sexual groping and holding him accountable for his malicious lies.”

President Trump’s attorneys have argued his words were opinions and protected speech made during the course of a competitive campaign.

The president's defense team was expecting to issue a response shortly.

Zervos has said Trump made unwanted sexual advances towards her, which he has denied. The first allegedly occurred in Trump’s office in 2007 when he kissed her.

The second allegedly occurred soon thereafter when Zervos went to meet Trump for dinner at the Beverly Hills Hotel, where she said he kissed her "open-mouthed," "grabbed her shoulder, again kissing her very aggressively, and placed his hand on her breast."

Zervos filed her defamation lawsuit three days before Trump's inauguration.

The trial judge has allowed discovery to move forward while the president’s appeal was pending. A deposition has been scheduled for some time before the end of June.

whitehouse says so what it was 25 years ago so she must be lying. Gee didn't he bring females whose claims were investigated by an independent counsel and found their claims were not credible because theyhad flip floped. Trump broght these females to a Hilary debate 30 years lter, and she did not have anything to do with them.

Whereas trump as some 30 that have come out against him persoanlly and he even admitted that he sexually molests females at will.

In a first-person account published Friday in New York magazine, writer E. Jean Carroll said she was raped by Donald Trump in the 1990s.

Trump denied the allegation in a statement from the White House late Friday.

Carroll, a longtime columnist for Elle magazine and the author of five books, details an encounter with Trump in the mid-1990s in the upscale Bergdorf Goodman department store in midtown Manhattan. Carroll was in her early 50s at the time. Trump and Carroll recognized each other in the store, and Trump told her he needed to buy a gift “for a girl,” according to Carroll’s account.

really trump right wingers hypocrites? come on, say it ain't so...

George Conway Warns Hypocritical GOP To Take Rape Accusation Against Trump Seriously
HuffPost Mary PapenfussHuffPostJune 22, 2019
Quote:
Attorney George Conway lashed Republicans in a scathing op-ed published Saturday, warning them to hold Donald Trump to the same standards they applied to Bill Clinton and take a new rape accusation against the president seriously.

Conway, husband of White House senior adviser Kellyanne Conway, pointed to Republican furor after retired Arkansas nursing home operator Juanita Broaddrick accused Clinton of rape, which he denied. Trump, who has been accused of sexual misconduct by 23 women, seated Broaddrick in a front row during one of his 2016 campaign debates with Hillary Clinton.

The new accusation against Trump of rape in a Bergdorf dressing room was detailed in a New York magazine piece by renowned advice columnist E. Jean Carroll. That accusation “rests upon a significantly stronger foundation than Broaddrick’s,” Conway argues in his piece in The Washington Post.

While Carroll went public with her accusation, Broaddrick denied for years — including under oath — reports that she had been sexually assaulted by Clinton, Conway notes.

Carroll’s account is also “supported by the sheer number of claims that have now surfaced against Trump ... [including] unwelcome or forcible sexual conduct or assault against them. These claims — all denied by the president — far outnumber the publicized sexual misconduct incidents that involved Clinton, which mostly concerned rumors or allegations of consensual affairs,” he writes. (Conway represented Paula Jones, who accused Clinton of sexual harassment.)

Conway says Carroll’s account of the alleged sexual assault is also supported by Trump’s “depraved” 2005 remarks on an “Access Hollywood” tape that surfaced during his 2016 campaign in which he boasts about how he treats women: “When you’re a star ... you can do anything ... grab them by the pussy.” He also preened that he “just starts kissing women ... I don’t even wait.”

Conway writes: “Whatever else he may have done, Clinton never made a video like that. What Trump described on the video is exactly what Carroll says he did to her.”

Trump has insisted he has “never met this person in my life” — which Conway slammed as another “utterly brazen, easily disprovable Trumpian lie.” Carroll included a photo with her article of Trump with ex-wife Ivana apparently speaking to Carroll at a gala.

Conway concluded: “Republicans or conservatives who promoted Broaddrick’s charges would be hypocritical if they fail to champion Carroll and condemn Trump.”

so now we know trump set up a private party of 28 children with just him and Epstein even though he was told by the event planner that epstein was a child rapist. Trump overruled him and said he would be their so no worries.

and remember Trump bragged about the fact he bought the miss teen pageant so he could walk in to the changing room of the children to be a voyeur. Many of the children were very upset of a male walking in on them.

I remember the story of trump telling in a pageant if you want to win come up to my penthouse room of the hotel for an interview.

most of these were known before the election and the right wingers consider those right wing values.

https://www.dailykos.com/stories/2019/10/9/1891301/-Trump-faces-43-new-inappropriate-behavior-allegations-including-sexual-assault-in-new-book?detail=emaildkre

Trump faces 43 new 'inappropriate' behavior allegations, including sexual assault, in new book

Quote:
Donald Trump is facing a fresh batch of misconduct allegations. On Wednesday, Esquire published an exclusive excerpt from the forthcoming book All the President's Women: Donald Trump and the Making of a Predator. Journalists Barry Levine and Monique El-Faizy use interviews from over 100 people to portray Trump’s history with women. As won’t surprise a single person, the stories largely portray Trump as a predator, in his political career, his real estate deals, and in his partying.

Esquire reports that the book includes 43 new allegations of “inappropriate behavior.” It specifies that 26 of those 43 involved unwanted sexual contact.

Before the emergence of the book, we already knew that two dozen women had accused Trump of sexual misconduct, ranging from groping to rape. Trump has denied all accusations and insulted numerous survivors who have come forward, brushing some off by saying they were “not his type.”

Esquire shares an excerpt from the book in which Karen Johnson alleges that while she was at a New Year’s Eve party at Mar-a-Lago in the early 2000s, Trump groped and kissed her after he materialized out of nowhere and pulled her behind a tapestry. “I was so scared because of who he was," Johnson said. "I don’t even know where it came from. I didn’t have a say in the matter.”

Given Trump’s own proclamation that “you can do anything” when you’re a “star,” including “grab them by the pussy,” this allegation seems right in line with his outlook. In fact, Johnson makes that connection herself in the Esquire excerpt. “When he says that thing, ‘Grab them in the pussy,’ that hits me hard because when he grabbed me and pulled me into the tapestry, that’s where he grabbed me—he grabbed me there in my front and pulled me in,” she says.

The book will be out Oct. 22.
