The way I understand their authority, is that they have the authority under AB 981 to establish a transportation management authority that includes tolls. Section 1967.5(a) of that bill provides that "The board of supervisors and the transportation authority, by a two-thirds majority vote of both bodies, shall have the authority to adopt a program imposing congestion pricing fees..."
This meeting is of both of those bodies. The law goes on to require, in Section 1967(b) that they make a finding of fact, also by a two-thirds vote, that "the congestion pricing fees have a relationship or benefit to the motor vehicle drivers who are paying the fee." Section 1967.6 also requires that the transportation program ensure public access to waterfront, recreational, and open space areas on Treasure Island.
Those of us who have been working on this challenge their ability to make such findings, particularly with respect to those traveling from the East Bay. As their EIR noted, and as testimony by users like Tom Gandesbery have put on the record, travel to the island for after work windsurfing, SUP ing, winging and so forth is counter commute, and does not benefit from the commuter ferry that they are subsidizing with this toll. However, the politics run against us. Any San Francisco Supervisor, or candidate for the Assembly, seems to be very happy to transfer the commute costs that they are responsible for mitigating to people who don't vote in their districts. The fundamental unfairness of this didn't bothered those on the TIMMA committee that voted to recommend these fees to the BOS.
The toll system was designed to subsidize the bus and ferry system that will primarily benefit commuters. It will probably increase travel off the island because it will make it more expensive for businesses that provide food, sundries, and medical care to operate on the island. It will more than double the cost to take your child to a little league game, or learn to sail at Clipper Cove, or go fishing. Please, if you are a voter in San Francisco, let your supervisor know this is a terrible idea, and you will be watching how they vote.
