As flagged by CBS News' Scott MacFarlane, prosecutors say that Brock wrote down his plan to overthrow the United States government on Christmas Eve, roughly two weeks before he and his fellow Trump supporters would storm the United States Capitol building.

As part of the plan, Brock outlined a series of "key tasks" that included initiatives to "seize all Democratic politicians and Biden key staff and select Republicans (Thune and McConnell)," at which point they would "begin interrogations using measures we used on Al Queda (sic) to gain evidence on the coup."

He then called for his fellow Trump supporters to "seize national media assets and key personnel," and then "eliminate them."

As if this weren't enough, he then issued a directive to "let the Democratic cities burn" and "cut off power and food to all who oppose us."

To cap everything off, he said that former President Donald Trump should then issue a "general pardon for all crimes up to and including murder of those restoring the Constitution and putting down the Democratic Insurrection."

Brock was convicted last year on multiple charges, including a felony obstruction of an official proceeding and five misdemeanor counts related to the riots.

interesting... but he will pardon all other criminals that broke laws for him. we need a amendment as I stated from the get-go of this thread that prevents a president from pardoning anyone who broke the law that he knew or directed or for their benefit.

"Article I, Section 3 of the Constitution states of impeachment, which is the most apparent remedy for presidential wrongdoing in office, that 'the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law.'"


"Given that impeachments cannot be pardoned under Article II, the impeachment language — which makes former presidents subject to the criminal laws for impeachable conduct — could be read to suggest that crimes related to impeachments cannot be pardoned, either," she explained.


She added that Section 3 of the 14th Amendment also presents a roadblock to the former president.

"If Smith’s grand jury indicts Trump under the section of federal sedition law which provides that '[w]hoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto . . . shall be incapable of holding any office under the United States,' a self-pardon would clash with the Supreme Court’s longstanding recognition, discussed below, that pardons cannot undermine other parts of the Constitution."

She writes that as they reviewed emails between him and Ukrainian government officials, she asked if he had to register as a foreign agent under the Foreign Agents Registration Act and offered to do the required paperwork for him.

The former mayor replied that he was allowed to violate Fara and other US laws because “[he had] immunity”, according to the lawsuit.

She then states that Mr Giuliani asked her “if she knew anyone in need of a pardon” because he was “selling pardons for $2 million, which he and President Trump would split”.

“He told Ms Dunphy that she could refer individuals seeking pardons to him, so long as they did not go through “the normal channels” of the Office of the Pardon Attorney, because correspondence going to that office would be subject to disclosure under the Freedom of Information Act,” the suit added.

No evidence has ever emerged that Mr Trump or Mr Giuliani were ever compensated for any presidential pardon granted during Mr Trump’s time in office, but Ms Dunphy’s allegation matches that made by another person who once sought a pardon from the then-president.

In August, The New York Times reported that former CIA officer John Kiriakou broached the topic with Mr Giuliani during a meeting at the Washington DC hotel Mr Trump’s company ran between 2016 and 2022.

Mr Kiriakou, who in 2012 was sentenced to nearly three years in prison for disclosing classified information, told the Times that one of Mr Giuliani’s associates at the meeting said the ex-New York City mayor could assist him — for a price.

“It’s going to cost $2 million — he’s going to want two million bucks,” he recalled the Giuliani associate as saying.

He also told the Times that he did not pursue a pardon through Mr Giuliani because he could not afford to pay him $2 million.

“I laughed. Two million bucks — are you out of your mind?” Kiriakou told the outlet. “Even if I had two million bucks, I wouldn’t spend it to recover a $700,000 pension,” he said.

Ted Goodman, a spokesperson for and adviser to Mr Giuliani, told The Independent in an email that the former New York mayor “unequivocally denies the allegations raised by Ms Dunphy”.

“Mayor Giuliani’s lifetime of public service speaks for itself and he will pursue all available remedies and counterclaims,” he added.

The Independent has reached out to Mr Trump’s team for comment.

Miles Taylor, who famously wrote a critical op-ed in 2018 in The New York Times using the pen name "Anonymous," quoted Trump's words in his new book Blowback: A Warning To Save Democracy From the Next Trump, that was obtained by Newsweek prior to its release on Tuesday.


Taylor, the chief of staff at the Department of Homeland Security (DHS) at the time, recalls accompanying the former president on a trip to the Mexican border in California on April 5, 2019.

"Everyone was waiting to see what would happen with Trump's on-again, off-again border threat. Would he seal the roads? Would he halt cross-border trade and travel?" Taylor writes.

He recalls Trump "pressuring" agents to seal the border, urging them to tell federal judges that the country was "full."

"Just say, 'Sorry, Judge, I can't do it. We don't have the room,'" Taylor quotes Trump as saying.

Trump was "telling them to ignore federal judges and deport people anyway, even if they had a right to be in the United States," Taylor writes.

A Customs and Border Protection leader—reportedly the agency's then commissioner Kevin McAleenan— tried to explain to Trump why that would be against the law, Taylor writes.


The then president offered a presidential pardon, according to Taylor.

"Seriously, keep them all out. Don't let any more in. If you go to jail for it, I'll pardon you," Taylor quotes Trump as saying.

It was that incident that prompted Taylor to resign, he claims. While Trump backslapped law enforcement officers in front of his border wall, Taylor says he stood on the sidelines drafting resignation letters on his phone.

"One was for me and the other was for [then Homeland Security Secretary Kirstjen Nielsen], though she hadn't officially asked for it," Taylor says. "In my mind, Trump had given us a gift—a reason to resign and shine a light inside his haunted house of a presidency."

Taylor adds: "If a pardon offer to break the law wasn't enough to justify quitting, then we deserved the label assigned to Trump officials who stayed too long: enablers."

Nielsen went to the White House the day after the border trip and told Trump she "couldn't violate federal statutes to repel what he termed an 'invasion' at the southern border," Taylor writes. "He fired her on the spot."

Newsweek contacted Nielsen through Taylor and McAleenan via LinkedIn on Tuesday.


Days later, when details about Trump proposing a "pardons-for-lawbreaking scheme to his DHS lieutenants" were reported in the media, Taylor writes that a "vengeful" president denied it and "launched a wider purge, ridding DHS of officials who were seen as insufficiently MAGA."

Taylor stayed on under McAleenan, who became the acting Homeland Security secretary, until resigning in June that year.

"I remained for a few weeks to provide the thinnest sinew of an orderly transition," he writes.

"I should have quit sooner," Taylor told Newsweek. "But this was my last straw. You cannot witness that kind of naked corruption and stay in the job—and in this case I still don't think he's been held fully accountable."

He added that the Trump administration was "a graveyard of potentially impeachable offenses, and we still don't know where all the bodies are buried."

It was only two years ago that Eliyahu Weinstein was told "two-thirds of his 24-year sentence for investment fraud was going to be commuted by President Donald J. Trump," The New York Times reported in 2021.

Weinstein hired a "well-connected Washington lobbyist" to handle the clemency appeal to the White House for his conviction for running a Ponzi scheme that The Times said, "stole millions of dollars from clients represented by Ari Mweisrot." The funds were never returned.

The report detailed how a pair of influential Jewish organizations that focus on criminal justice issues were behind the lobbying efforts. One of those groups, the Tzedek Association along with Alan Dershowitz and former U.S. attorney for Utah Brett Tolman were credited with the decision.
