Prosecutors in the Southern District of New York found substantial evidence against Trump during their investigation, which resulted in charges against his former attorney Michael Cohen in 2018, but did not consider charging him at that time due to Justice Department guidance that a sitting president cannot be indicted, but that changed by January 2021, according to a new book from CNN senior legal analyst Elie Honig.

“The draft Cohen indictment was a full accounting, running over fifty pages in one iteration – essentially both a formal indictment of Cohen and a public excoriation of Trump, only without charges attached,” Honig wrote in his forthcoming book, Untouchable. “The SDNY’s draft indictment left no doubt: Trump wasn’t merely a bystander or an unwitting beneficiary of the campaign finance crime. He was the driving force behind the scheme, and likely criminally liable for it.”

However, nearly all those details about Trump's role were missing from the indictment by DOJ officials, who softened the description of the former president in that document from "Co-conspirator 1" to "Individual-1."

“In DOJ’s view, the Trump-specific language was superfluous and threatened to harm the reputation of an unindicted party,” Honig wrote. “It would be unfair to Trump, and potentially damaging more broadly to the country, to effectively accuse the sitting president of a crime without affording him a formal mechanism to defend himself.”

Federal law enforcement officials changed their view after the Jan. 6 insurrection, when acting U.S. attorney Audrey Strauss held multiple discussions with a small group of prosecutors to discuss their evidence against the outgoing president -- although they ultimately decided against an indictment, Honig wrote, because his post-election actions “made the campaign finance violations seem somehow trivial and outdated by comparison.”

“We were well aware of the prudential reasons why you wouldn’t charge a president, even after he was out of office,” one source with knowledge of the investigation told Honig.

again trump never said cohen was lying about his testimony to congress, never filed charges or sued him for lying.

Grand jury to reportedly hear evidence in Trump hush money case

The Manhattan district attorney’s office on Monday will begin presenting evidence to a grand jury about Donald J. Trump’s role in paying hush money to a porn star during his 2016 presidential campaign, laying the groundwork for potential criminal charges against the former president in the coming months, according to people with knowledge of the matter. The grand jury was recently impaneled, and witness testimony will soon begin, a clear signal that the district attorney, Alvin L. Bragg, is nearing a decision about whether to charge Mr. Trump.

According to the Times’ reporting, which has not been independently verified by MSNBC or NBC News, prosecutors have already sought interviews with witnesses. In fact, one witness was seen today entering the New York building where the grand jury is sitting: David Pecker, the former publisher of The National Enquirer, the tabloid that helped broker the deal with Stormy Daniels.

In case anyone needs a refresher let’s revisit our earlier coverage and review how we arrived at this point.

In a normal political environment, it would’ve been a career-ending scandal. Then-candidate Trump, in the run-up to Election Day 2016, allegedly paid illegal hush money to Daniels, a prominent a porn actress, in the hopes of keeping secret an alleged extramarital affair. The Republican’s fixer, Michael Cohen, took the lead in orchestrating the illegal payment.

Cohen was ultimately charged, prosecuted, convicted, and sentenced to prison, even as his former client was rewarded with the presidency.

The closer one looks at the relevant details, the worse the controversy appears. Not only did Cohen directly implicate Trump in the scandal, telling a court he arranged the illegal hush money payments at the instruction of his client, but the former president, while in office, was also caught lying about what transpired.

It’s long been an open question as to why Trump wasn’t also charged in the case. If the Times’ reporting is correct, the door is now open to a possible indictment.

again when he Cohen testified before congress, if he lied Trump Barr would have been able to extend his prison term. And when took the conviction trump and Barr could have pardoned him if it was a lie.

With those two axioms we can conclude Cohen testified truthfully.


also noter officially they have invited trump to testify in front of this grand jury. The only issue for him is he has to answer all questions no taking the 5th his 400 times he did in a recent gerorgia grand jury where you could do that.




Michael Cohen, Donald Trump’s ex-fixer, is set to testify before a grand jury next week, as a likely indictment of the former president looms.

well ge he took a tax write off in lawyers fees, he said it was to protect his wife, BS... she does not look at his books so he could have wrote a check. You do not have a confidentiality agreement if you do not know about it. Lets see his signed confidentiality agreement because I bet it does not cover him.

Brewster added on Twitter that his client “responded to questions and has agreed to make herself available as a witness.”

This appears to have rattled the former president a bit. He published this missive shortly before midnight on his social media platform:

“I did NOTHING wrong in the ‘Horseface’ case. I see she showed up in New York today trying to drum up some publicity for herself. I haven’t seen or spoken to her since I took a picture with her on a golf course, in full golf gear including a hat, close to 18 years ago. She knows nothing about me other than her conman lawyer, Avanatti, and convicted liar and felon, jailbird Michael Cohen, may have schemed up. Never had an affair with her, just another false acquisition by a SleazeBag. Witch Hunt!”

There was all kinds of nonsense packed into this state

With this in mind, Jordan, Comer, and Steil effectively asked why the Manhattan district attorney’s office would disregard the Justice Department’s conclusion and consider going in the opposite direction. In fact, to hear the committee chairs tell it, the fact that Bragg is moving forward after federal prosecutors passed on the case is necessarily evidence of the local prosecutor going too far.

There is, however, a highly relevant detail that Republicans are conveniently overlooking.

As Rachel explained on last night’s show, it’s true that this case was initially a federal case, initiated by federal prosecutors in the Southern District of New York. In fact, they’re the ones who prosecuted Michael Cohen, who paid Stormy Daniels in the hush money scandal.

At that point, did federal prosecutors conclude that the case was simply over and walk away? Not exactly.

What they actually found was that Cohen acted at Trump’s direction and to Trump’s benefit. Why didn’t prosecutors pursue the matter further? According to Geoffrey Berman — the Trump-appointed U.S. attorney in the Southern District of New York, who wrote a book about his experiences — it’s because there was political interference from other Trump appointees who ordered prosecutors to end their investigation.

Indeed, according to Berman’s book, then-Attorney General Bill Barr not only intervened in the case, he tried to kill the ongoing investigation and even suggested that Cohen’s conviction should be reversed.

The GOP committee chairs wrote yesterday that federal prosecutors “determined that no additional people would be charged alongside Cohen,” but they conveniently overlooked why they made that determination.

It wasn’t because of a thorough review of the law; it was because Trump’s attorney general told them to stop — because in the previous administration, the brazen politicization of federal law enforcement was the norm.

Were Jordan, Comer, and Steil unaware of these details, or did they simply choose not to care?
