Trump could get sued by E. Jean Carroll again over his Truth Social outbursts: report

Quote:

As Donald Trump deals with the blowback from being found liable for the sexual battery and defamation of writer E. Jean Carroll, he has reportedly opened himself up for a new lawsuit through his rants on Truth Social.

Just after the former president was ordered to pay Carroll $5 million, he went on his own social media platform and once again called her a liar. This is the same conduct that led to her first lawsuit, and could in fact open him up to a second one on similar grounds, according to a Wednesday report from the New York Times.

"Hours after a Manhattan jury on Tuesday found that former President Donald J. Trump had sexually abused and defamed the writer E. Jean Carroll, Mr. Trump went on social media to call her a liar," the article states. "His unrelenting commentary on Ms. Carroll, her lawsuit and even the judge in the civil trial, Lewis A. Kaplan, raises questions about what repercussions Mr. Trump could face in any motions he makes before Judge Kaplan or in a promised appeal, or whether he could face a new defamation lawsuit."

The Times interviewed experts who said that, while Kaplan wasn't likely to impose sanctions for after-trial conduct, a new defamation lawsuit is entirely possible.

"Ms. Carroll could bring a new defamation lawsuit against Mr. Trump based on his recent comments, experts said," the article states.

“He doesn’t get carte blanche to defame her because she sued him once and collected and won,” said Stephen Gillers, a legal ethics professor at New York University School of Law, according to the New York Times.

"Ms. Carroll’s lawyer, Roberta A. Kaplan, and Mr. Trump’s lawyer, Mr. Tacopina, had no comment."

another case with trump involved..

https://www.msn.com/en-us/news/politics/justice-dept-seeks-to-put-trump-deposition-on-hold-in-case-of-fbi-agent-fired-over-text-messages/ar-AA1b4e2F?ocid=winp2fptaskbarhover&cvid=e3d1ba36c10f4338b88ce8dd11d5d605&ei=33

Justice Dept. seeks to put Trump deposition on hold in case of FBI agent fired over text messages

Quote:
WASHINGTON (AP) — The Justice Department asked a judge Thursday to put on hold a scheduled deposition of Donald Trump in a lawsuit brought by an FBI agent who was fired over text messages critical of the former president.

The government said in a federal court filing that a judge should order lawyers for Peter Strzok to take the deposition of FBI Director Christopher Wray before they seek to question Trump. The Justice Department says an interview with Wray may eliminate the need for Trump's deposition, and that if the judge handling the lawsuit does not grant its request, it will ask a federal appeals court to intervene.

Lawyers for Trump support the Justice Department’s position, according to a footnote in the government’s filing, while Strzok’s attorneys oppose it. Strzok's legal team has scheduled the deposition for May 24.

Strzok was a veteran counterintelligence agent and a lead official in the FBI's investigation into Hillary Clinton's use of a private email server as secretary of state and into Russian election interference and potential coordination between Moscow and the 2016 Trump campaign.

The filing comes as Trump finds himself the subject of criminal investigations by a Justice Department special counsel into efforts by him and his allies to overturn the results of the 2020 presidential election, as well as into the retention of classified documents at his Mar-a-Lago estate in Florida.

But when it comes to deposing a current or former high-level government official in a civil matter, the Justice Department notes, a party must show there are “extraordinary circumstances" for the interview.

“These circumstances do not rise to the ‘extraordinary circumstances’ necessary to authorize the deposition of a current or former high-ranking government official, much less a former President,” the Justice Department wrote.

He sued in 2019, saying the FBI had caved to “unrelenting pressure” from Trump when it fired him and that he was unfairly terminated for expressing his political opinions.

As part of the lawsuit, Strzok's lawyers have said they want to question Trump about whether he met with and pressured FBI and Justice Department officials to fire him.

But the Justice Department says that the former FBI deputy director, David Bowdich, has already said that he made the decision to fire Strzok on his own, and that he did not recall Wray ever telling him about any meeting with Trump in which the president pressured him about Strzok.

Trump kids stripped from lawsuit to speed up another Donald Trump trial

Quote:
Donald Trump will face trial in yet another civil case on an expedited schedule now that his children, Donald Trump Jr., Eric Trump, and Ivanka Trump, have been voluntarily dropped from the case after they made it clear their father was the "principle architect" of the conduct called into question.

The lawsuit dates back five years, when viewers of the Apprentice sued Trump, his company, and his kids. According to the lawsuit, they were conned into paying thousands of dollars for desktop videophones that Trump touted as the next big piece of technology. In reality, they were rendered obsolete by smartphones, according to Bloomberg.

"Donald Trump won’t be joined by his children when he goes to trial in a civil suit alleging he ripped off viewers of his Celebrity Apprentice TV show for years by pitching investments in a doomed desktop videophone — a device he insisted was the next big thing," the outlet reported.

Bloomberg continues: "Former Trump fans who filed the suit five years ago voluntarily dropped Donald Trump Jr., Eric Trump and Ivanka Trump as defendants to streamline the dispute ahead of a trial set for January, according to a stipulation between the parties signed Friday by the judge overseeing the case."

Interestingly, the case will still feature the depositions with Trump's children. Those depositions reportedly show that the kids pointed to their dad as the one responsible for the purported conduct.

"The sworn depositions of the Trump children 'made clear' that the former president 'was the architect, principal actor, and largest beneficiary of the fraudulent scheme,' plaintiffs’ lawyer Roberta Kaplan said in a statement," Bloomberg added. "As part of the agreement, depositions testimony from the three children — who worked closely with their father while his TV show aired — can still be used at trial. The former president and his company, Trump Corp., remain defendants."

The case that’s opened the door to another hazardous Trump deposition

Quote:

It’s been a while since Peter Strzok and Lisa Page generated front-page headlines, but they were prominent figures in the investigation into Donald Trump’s Russia scandal. Strzok, for example, was the senior FBI official who helped lead the initial probe of ties between Russia and the Trump campaign.

In time, however, 2016 text messages he sent to former FBI lawyer Lisa Page, in which they disparaged the future president, came to light, and they were kicked off then-special counsel Robert Mueller’s investigation. Page ultimately resigned in 2018, and the same year, Strzok was fired.

In the months and years that followed, Strzok and Page remained the target of Republican ire and conspiracy theories, and according to former White House chief of staff John Kelly, Donald Trump wanted the IRS and the Justice Department to go after Page and Strzok, even after their ouster from the FBI, during his presidency.

Their story, however, is far from over. Strzok filed a civil suit against the bureau, arguing that he was wrongfully terminated, while Page also sued, alleging privacy violations.

The litigation is ongoing, though as NBC News reported, there was a court development of note this week.

A federal judge on Thursday rejected an effort by the Justice Department to prevent former President Donald Trump from sitting for a deposition related to a pair lawsuits filed by former FBI officials Peter Strzok and Lisa Page. The order, issued by U.S. District Judge Amy Berman Jackson of Washington, D.C., is a victory for Strzok’s attorneys, who are seeking Trump’s deposition to determine whether he met with and directly pressured FBI and Justice Department officials to fire Strzok or urged any White House aides to do so.

Time will tell, of course, whether the allegations prevail in court. I’m of the opinion that Strzok has a credible case — he appears to have been fired outside the bureau’s normal disciplinary process — but there’s plenty of litigating still to come.

In the meantime, however, what I care about is the fact that Trump will be deposed in this case. This is of interest because the Republican’s depositions never
In 2021, for example, a court ordered Trump to testify under oath in a lawsuit brought by protestors who were allegedly roughed up by his security guards outside Trump Tower in New York. During his deposition, the former president said he feared protesters would hit him with tomatoes, pineapples, and other “very dangerous” fruit, declaring — in apparent seriousness —that “you can be killed if that happens.”

Trump also gave a deposition in E. Jean Carroll’s defamation case, which went even worse for him. According to his testimony, which was featured during the trial, Trump considered himself a star, and he believed it’s “largely true” that stars have been able to get away with assaulting women “over the last million years ... unfortunately or fortunately.”

In the same deposition, Trump confused Carroll with his second wife — undermining his indefensible rhetoric about his “type” — and struggled to remember the details of his adulterous past.

I can’t wait to see what Strzok’s lawyer gets him to say
