Jibe collision, wing vs wind foil

If hit by someone who is jibing who is at fault? The hittee, windsurf foil, is astern and leeward by multiple hull lengths in both ways (making them the give-way vessel?). The hitter is a wing, limited visibility and unaware of windsurfer behind, who doesn't dip or raise the wing to look astern before initiating a jibe. Collision damages windsurf board, no injuries. Please provide link to rule if possible. Thx.

Jiber is at fault; he changed direction. He should have looked behind, seen you there &:

1. Held his course until he could safely jibe.

2. Tacked.

3. Pinched up wind until he could safely jibe.

4. Sped up, steer downwind until safely in front of you then jibe down wind of you.

5. Signaled to you that he wanted to jibe so you could change course & give him room.

That regulation states "Existing law requires that a complete copy of the inland navigation rules must be kept for reference on board all boats of 39 feet 4 inches (12 meters) or more in length operating on inland waters.".

A good lawyer would argue that it thus applies only to boats over 12 meters, not to our highly maneuverable water toys.

And in our recreational community, how does maritime law stack up to DTL wave sailing "rules", or when the front sailor is approaching shore and HAS to do something, or when the lee/aft sailor is on equipment that can outpinch the frontrunner, or when the sailor in front isn't quite jibing, but sure is turning sharply and often? Such actions invoke the use of such things as camaraderie, watching out for one's self and the other guy, letting people play, intermediates giving up unique hot spots to the folks that can handle them (e.g., a guy who can't jibe shouldn't clog up a spot jampacked by experts, expecting them to avoid his moving roadblock presence), etc ... all of which has been discussed at great length and depth in the past.
