Smartmatic's motion states that Fox News and its hosts "joined forces" with Rudy Giuliani and Sidney Powell, two attorneys representing the re-election campaign of then-President Donald Trump, knowing that the attorneys would make false claims against Smartmatic.


Trump's lawyers alleged that Smartmatic and other voting machine companies assisted in a nationwide conspiracy to rig their machines' vote counts against Trump.

Smartmatic's lawsuit claims that Fox News hosts Maria Bartiromo, Jeanine Pirro and former host Lou Dobbs knew that Trump's lawyers would lie about Smartmatic. Furthermore, the filing claims, the hosts added their "own defamatory comments," and did it it all for "personal gain."

"The Fox anchors were not innocent bystanders and the disinformation generated during their interviews was no accident. Prior to the interviews, the Fox anchors decided to join forces with Giuliani and Powell to disseminate disinformation about Smartmatic," the filing states.

Smartmatic's initial lawsuit, filed in early February, alleged that Fox News had made 192 defamatory statements in 41 broadcasts, online articles and social media posts. These statements "destroyed" Smartmatic's reputation, caused its offices to be picketed and its employees and leaders to be harassed, the lawsuit said.

In 2015, word spread online that a routine military exercise in the southwest, called Jade Helm 15, was a plot by President Barack Obama to impose martial law and seize everyone’s guns. The paranoia was “fueled by conservative bloggers and Internet postings,” the New York Times reported. So far did the claim spread that Gov. Greg Abbott ordered the Texas State Guard to monitor the exercise.

At the time, Americans responded to such bizarre online happenings with exasperation and bemusement. But the paranoia was fueled by more than conservative bloggers and Internet postings. Former CIA director Michael Hayden later said that Russian propagandists were behind the campaign. They were probing for vulnerabilities to disinformation — and found them. “At that point I think they made the decision, ‘We’re going to play in the electoral process,’” Hayden said.

Americans are no longer so naive about foreign attacks on our information space. The news media, the government and the public did a better job of recognizing and resisting information warfare from outside adversaries in 2020 than four years earlier.

But what if a far larger, more sophisticated and more ruthless disinformation campaign against American democracy originated within the United States? Would we recognize and respond to the threat? The answer so far is no — or, at best, only partially.


Most people regard Republicans’ #StopTheSteal campaign, also known as the “big lie,” as an attempt to re-litigate the 2020 election and pander to a radicalized, Trumpy base. It is that, but it is also a massive and devastatingly effective deployment of Russian-style information warfare against American democracy — by Americans themselves — with an eye toward the future. We should think of it not as a momentary partisan outburst but a kind of epistemic 9/11: a moment when a menace that has been developing for years reaches maturity and displays its full prowess.

Attacks on the concept of objective truth are not new. Left-wing attacks on objectivity date at least to the 1970s, with the rise of academic trends such as deconstructionism and postmodernism. Not long after, conservative media began attacking truth systematically, for example, through the rise of demagogues like Rush Limbaugh, who railed against the “four corners of deceit” (government, academia, science and the media).

Fox News Parts With Andrew Napolitano After Sexual Harassment Accusation From Male Staffer

Fox News revealed Monday that it has parted ways with Judge Andrew Napolitano after multiple accusations of sexual harassment including one from a male staffer at the network.

It is not known exactly when Fox News cut ties with Napolitano, a former New Jersey Superior Court judge who became a legal analyst and frequent on-air personality and host for Fox News beginning in 2006. He was one of the rare Fox News personalities who spoke out against former President Donald Trump during his time in office but has not appeared on air for several months.

The network announced the news in a statement Monday morning responding to a separate lawsuit involving Fox Business Network host Larry Kudlow, who was accused of making racist and sexist remarks. The lawsuit’s plaintiff, associate producer John Fawcett, also accused Napolitano of sexual harassment in a 2019 elevator encounter.

“Upon first learning of John Fawcett’s allegations against Judge Andrew Napolitano, Fox News Media immediately investigated the claims and addressed the matter with both parties. The network and Judge Napolitano have since parted ways,” the media company said in a statement to TheWrap, without specifying the timing of its investigation or of Napolitano’s exit. “We take all allegations of misconduct seriously, are committed to providing a safe, transparent, and collaborative workplace environment for all our employees and took immediate, appropriate action,” the spokesperson continued.

The network’s legal analyst was also accused last year by two men for sexual assault, which Napolitano said was “completely false” — and at the time the network stood by Napolitano.

It is highly amusing to watch election night flipping back and forth from MSNBC to Fox. The recall goes down in a landslide. Larry Elder spent 3 months pounding nails into the coffin of the Republican Party here in California. The Fox commentators just can't seem to understand it.

Here’s an important fact or two. California’s positivity test rate for Covid is 2.9%. Mississippi’s is 30.4%. Our vaccination rate is over 57%. Mississippi’s is 41.3%.

Fox News celebrates 25th anniversary as critics point to network’s dark history

“Nobody ever thought we would be successful. Nobody ever thought we would compete. And they were all dead wrong,” Hannity claimed. “This channel now has dominated the airwaves for decades, all while giving a voice to the forgotten men and women in this country.”

On Thursday, the Hill reported the Empire State Building in New York City would be illuminated in red, white and blue this weekend to celebrate the anniversary. The report drew outrage online, with some users on Twitter suggesting the building should, in fact, be under “total blackout for spreading lies and falsehoods”.

A spokeswoman for the building did not immediately respond to a request for confirmation from the Guardian and the report had not been confirmed elsewhere.

As the channel celebrated its anniversary into the evening, hosts on different networks were keen to mark the event with an entirely different take.

The late-night talkshow host Jimmy Kimmel, who presents on the ABC network, used his opening monologue to remind viewers of the channel’s frequent extremist rightwing rhetoric and racist dog whistles, with a reference to the realm of evil created in JRR Tolkien’s Lord of the Rings trilogy he added they had been “celebrating all day over at Mordor”.

“That’s right,” Kimmel said on Thursday. “Fox News is now old enough to rent a car, fill it with immigrants, and claim it’s heading to your grandma’s house to bury her alive.”

Despite financial and ratings success, Fox News continues to reel from a series of sexual harassment scandals that led to a number of its senior staff including former presenter Bill O’Reilly and founding CEO Roger Ailes departing the company in recent years.

On Thursday other commentators made reference to these , with Trevor Noah’s Daily Show airing a reel of the network’s worst on-air moments of sexual discrimination and harassment.
