The Project on Government Oversight, a government watchdog group, sued for the transcript and shared it with the Washington Post.


Giuliani, who spoke with agents for DOJ Inspector General Michael Horowitz in a room at former President Donald Trump’s hotel in downtown Washington, D.C., in February 2018, said it was okay to “throw a fake” when campaigning, the notes show. Marc Mukasey, Giuliani’s then-law partner and counselor, said, "there’s no obligation to tell the truth.”

The release of the transcript, which is lightly redacted, comes less than a week after the release of a DOJ inspector general report on the FBI’s “culture of unauthorized media contacts” in 2016, revealing investigators failed to identify FBI leakers from the 2016 presidential campaign while casting doubt on the notion that Giuliani was the benefactor of leaks related to the bureau investigation into Hillary Clinton's use of an unauthorized email server.

Giuliani, who backed Trump in 2016 and later became his personal attorney, had been asked about Trump’s campaign and told Fox News on Oct. 26, 2016, that “I think he’s got a surprise or two that you’re going to hear about in the next few days. I mean, I’m talking about some pretty big surprises."

Two days later, then-FBI Director James Comey informed Congress that the FBI was reopening the Clinton email investigation. Clinton, who was the Democratic presidential nominee at the time, was criticized but not charged for her use of a private email server without approval during her time as secretary of state.

“The other rumor that I get is that there’s a kind of revolution going on inside the FBI about the original conclusion being completely unjustified and almost a slap in the face to the FBI’s integrity. I know that from former agents. I know that even from a few active agents," Giuliani subsequently said on the radio.

On the contrary, the Coomer vs Trump Campaign case has also produced depositions from a variety of political players who were also involved in propagating nonsensical claims about the 2020 election. They've already answered questions, under oath, about their role in spreading conspiratorial falsehoods.

Take Rudy Giuliani, for example.

In this same defamation case, attorneys sat down with Donald Trump's infamous lawyer last month and asked about the origins of the Republican conspiracy theories, specifically related to voting machines — a core element of the GOP's anti-election push. As part of the deposition process, Giuliani, among others, was required to answer questions under oath, which in turn offers the public a window into how the nonsense became an animating principle for the former president and his allies.

The core question for the former New York City mayor was simple: Where did all this weird stuff come from? Giuliani was asked, for example, about media reports in which he said he'd relied on some media accounts and social media posts in order to go after a Dominion Voting Systems executive. Giuliani responded that he couldn't remember if it was Facebook or some other platform. "Those social media posts get all one to me," he said.

Giuliani added that he couldn't think of anything else "that I laid eyes on." This was itself amazing: Before going public with anti-election conspiracy theories, Giuliani's due diligence involved reading some stuff via social media — though he's not sure which platform.

The former president's lawyer also told the public he knew of a witness who could bolster the allegations against Dominion. In the deposition, Giuliani conceded that he didn't actually speak to the alleged witness, but he thinks someone else on Team Trump probably did.

Giuliani also said he didn't have any information about the alleged witness' credibility, and didn't make an effort to check. From the transcript:

"It's not my job in a fast-moving case to go out and investigate every piece of evidence that's given to me. Otherwise, you're never going to write a story."

He added that he didn't have the time to check whether the alleged witness' claims were reliable before sharing them with the public.

Rachel summarized Giuliani's message this way: "I read some stuff — I think it was maybe on Facebook — I laid it out to the public as what we knew to be the facts, and no, I had no idea if it was true or not. I didn't even try to check. Why would I try to check? You wouldn't have a story then."

At face value, it's tempting to laugh at the absurdity of Giuliani's deposition. Similarly, it's hard not to wonder how much longer he'll be permitted to have a law license.

But let's not forget that the bonkers conspiracy theories Giuliani and his associates pushed weren't just lies, they were toxins that entered the political world's bloodstream. The political system's resulting sickness isn't going away.

The former mayor, who has served as Trump's personal attorney, did not respond to requests by Reuters for comment.

A spokeswoman for the U.S. Attorney for the District of Columbia did not immediately respond to a request for comment.

The source said the subpoena sought, among other things, copies of any retainer agreements between Trump and Giuliani, or the Trump campaign and Giuliani, and records of payments and who made those payments.

In December, a District of Columbia attorney ethics committee said Giuliani violated at least one attorney ethics rule in his work on a failed lawsuit by Trump challenging the 2020 election results.

Giuliani's New York state law license was suspended in June 2021 after a state appeals court found he had made "demonstrably false and misleading" statements that widespread voter fraud undermined the 2020 election won by his Democratic opponent, Joe Biden.

The case in question centers on two Georgia poll workers who claim Giuliani defamed them with accusations of election fraud during the 202 presidential election.

On Friday Howell ordered Giuliani to hand over a "detailed accounting of his finances and net worth," and the Politico report notes that Giuliani continued to complain to the judge despite his attorney, Joseph Sibley, trying to rein him in.

"The former mayor said complying with the document demands in the poll workers’ libel suit was complicated by the fact that the FBI seized all of his electronics in April 2021, as prosecutors investigated potential violations of foreign-agent laws in connection with Giuliani’s work in Ukraine," Gerstein wrote before adding the "indignant" Giuliani exclaimed to the judge, "I’ve been dealing with this for 50 years. I understand the obligation. There’s nothing I want to hide. I’d like them to see everything. … Not being perfect doesn’t mean you’re deleting things. I don’t delete things.”
