Team Trump leaks National Archives letter, hurts its own cause

In sports, there’s a phenomenon sometimes known as an “own goal.” The basic idea is, there are competing teams, each trying to score a goal against their rival, but sometimes things go horribly awry and a team accidentally helps its rival by scoring a goal against itself. YouTube offers plenty of embarrassing examples highlighting such incidents.

Of course, the phenomenon isn’t limited to sports. In politics, we occasionally see parties, candidates, and politicians with “own goal” problems of their own. Rachel highlighted some memorable examples last year, noting Republican recount efforts, intended to cast doubts on the 2020 presidential election, which ended up showing Donald Trump losing by an even larger margin.

Last night, Team Trump seemed to kick the ball into its own net once again. Politico reported:

The National Archives found more than 700 pages of classified material — including “special access program materials,” some of the most highly classified secrets in government — in 15 boxes recovered from Donald Trump’s Mar-a-Lago estate in January, according to correspondence between the National Archivist and his legal team.

It was John Solomon, a conservative writer and one of Trump’s authorized Archives liaisons, who published online a May 10 letter from the National Archives and Records Administration (NARA). As Politico’s report added, the document showed that NARA and federal investigators “had grown increasingly alarmed about potential damage to national security caused by the warehousing of these documents at Mar-a-Lago, as well as by Trump’s resistance to sharing them with the FBI.”

I have no idea why someone from Team Trump would voluntarily show this to the public. It not only bolsters damaging reporting about the Mar-a-Lago scandal, it also makes the former president look worse, not better.

Indeed, the NARA letter confirms that Trump took highly classified national security materials to his glorified country club. It confirms that the Republican’s haul was extensive and wasn’t limited to a handful of documents. It confirms that the National Archives was amazingly accommodating, accepting multiple delays in the hopes that the former president would eventually cooperate and return the secrets he wasn’t supposed to have.

Also notable is what wasn’t mentioned: If Trump had declassified any of the materials, he and his lawyers hadn’t mentioned this to NARA.

It’s possible that this May letter was leaked in the hopes of proving some kind of political interference on the part of the Biden White House, but the document itself points in the opposite direction: The incumbent Democratic president deferred decisions related to executive privilege to NARA and Justice Department lawyers.

Politico’s Kyle Cheney, who called the NARA letter “extraordinarily damning“ for the former president and his team, put together a worthwhile Twitter thread on the developments and highlighted another angle I haven’t seen elsewhere: “Trump has been on notice since at least May of the FBI’s efforts to access this material. So his motion to seek a special master following the execution of the search warrant is months — not just weeks — late.”

If the former president’s critics are fortunate, Team Trump will continue to “help” the Republican with disclosures like these.

Additionally, the Journal reports that federal law enforcement officials were tipped off by "at least one person familiar with the location of the documents at the complex," and that this tip alarmed them to the point where they felt they needed to execute a search warrant at the former president's residence.

In a letter sent by the National Archives to Trump earlier this year that was revealed on Monday evening, the agency said it had found " items marked as classified national security information, up to the level of Top Secret and including Sensitive Compartmented Information and Special Access Program materials" in documents that Trump had already handed over.

Special Access Program materials, notes the Journal, are some of the most sensitive secrets the government has, and are "generally accessible only in specially designed Sensitive Compartmented Information Facilities, or SCIFs."

The email, sent on May 6, 2021, by the top lawyer at the archives, Gary M. Stern, was an early sign of tension between Mr. Trump and the federal agency responsible for safeguarding presidential records. It presaged the battle that would later erupt over the former president’s removal of scores of highly sensitive documents from the White House.

On Tuesday, the archives released a separate letter, indicating that Mr. Trump had taken more than 700 pages of classified materials when he left Washington. Among them, the letter said, were some related to Special Access Programs, which are among the country’s most secretive intelligence operations.



Mr. Stern’s email did not mention any classified materials, but it did help to further flesh out the cascading events that ultimately led to an investigation into whether Mr. Trump wrongfully kept hold of national security documents and other presidential records.

That investigation, which has included steps like the issuance of federal subpoenas and a visit to Mr. Trump by top counterintelligence prosecutors, reached a new level this month when F.B.I. agents conducted a court-approved search of Mar-a-Lago, the former president’s private club and residence in Florida, and carted off more sensitive government documents, including some marked with high levels of classification.

In his email, Mr. Stern noted that there were two sets of documents in particular the archives could not find: the original correspondence between Mr. Trump and the North Korean leader Kim Jong-un, and a letter that President Barack Obama had left for Mr. Trump on his first day in office.


Mr. Stern told the lawyers that just before Mr. Trump left office, the letters from Mr. Kim were placed in a binder for the president but never made their way to the archives, as required by the law. “It is essential that these original records be transferred to NARA as soon as possible,” he wrote, using the acronym for the National Archives and Records Administration.

Mr. Stern’s email was addressed to Scott Gast and Michael Purpura, two of Mr. Trump’s personal lawyers, and to Patrick F. Philbin, who served as a senior lawyer in Mr. Trump’s White House Counsel’s Office. Another official at the archives, John Laster, also received a copy.

Mr. Philbin and Pat A. Cipollone, the top White House lawyer at the end of the Trump administration, have been interviewed by the F.B.I. in connection with the inquiry into the sensitive documents stored at Mar-a-Lago after Mr. Trump left office, according to people familiar with the matter.

Aside from the letters from Mr. Obama and Mr. Kim, Mr. Stern also said that “roughly two dozen boxes of original presidential records” that Mr. Trump had kept in the White House residence during his final year in office had not been given to the archives. In his email, Mr. Stern said the archives never received the materials even though Mr. Cipollone had determined that they should have been turned over, though it remained unclear what White House officials were told about the boxes.

A spokeswoman for Mr. Cipollone and Mr. Philbin declined to comment on the email, as did an adviser to Mr. Gast. Mr. Stern and Mr. Purpura did not respond to messages seeking comment.

At one point in his email, Mr. Stern acknowledged that “things were very chaotic” at the end of Mr. Trump’s time in the White House, “as they always are in the course of a one-term transition.” He added that the transfer of Mr. Trump’s records to the archives would not be “complete for several more months.”

“But it is absolutely necessary,” he concluded, “that we obtain and account for all original presidential records.”

not only that he used that to put in jail a person for 83 months for one document. Gee that document that was classified and released was a classified document about trump and interference of the Russians to assist trump being elected.

here you get to hear trump attack clinton and run on lock her up for mishandling classified info. How it would never happen again .. When his own in-justice department found she was not to be charged because she did not know there was classified info and much of it became classified after the fact.
